PRIVATE HEALTH INSURANCE BRANCH

DEPARTMENT OF HEALTH AND AGEING

MARCH 2007

Overview

The Health Insurance Act 1973 was enacted to facilitate a national system of health insurance in Australia, aiming to provide equitable access to health services and manage healthcare costs effectively. One of the key provisions of the Act allows the Minister for Health to determine the levels of patient contributions for various healthcare services, including nursing-home type patients in recognized hospitals. This specific legislative instrument, HIB 05/2007, was introduced to address the need for an updated patient contribution rate for nursing-home type patients in Queensland. The policy objective behind this determination is to ensure that the patient contribution levels are reflective of the current economic conditions and healthcare costs, thereby maintaining the sustainability of the national health insurance scheme. This determination, issued by authority of the Minister for Health and Ageing, was made following consultation with Queensland Health and sets the patient contribution at $38.20 per day, effective from 20 March 2007.

Scope and Application

The Health Insurance Act 1973 applies to a broad spectrum of individuals and entities within the healthcare sector, particularly those involved in private health insurance arrangements. This legislation outlines the framework for the regulation and administration of private health insurance in Australia, impacting patients, health insurers, and healthcare providers. The Act is applicable on a national level, governed by the Commonwealth, and seeks to standardise health insurance practices across the country. The particular determination under subsection 3(1)(HIB 05/2007) specifies that the Minister may set patient contribution levels for nursing-home type patients in recognised hospitals within the states, with this instance focusing on Queensland. This determination sets the patient contribution amount at $38.20 per day, effective from 20 March 2007. Notably, this determination does not explicitly exclude any groups or entities, though its application is limited to recognised hospitals in Queensland, thereby ensuring that the specified patient contribution levels are uniformly implemented within the designated jurisdiction. The determination is a specific application of the broader provisions of the Act, and any further extensions or restrictions would typically be detailed in subordinate instruments or additional determinations by the Minister.

Key Provisions

The main operative sections of this determination, issued under subsection 3(1) of the Health Insurance Act 1973 (the Act), pertain specifically to the level of patient contribution for nursing-home type patients in recognised hospitals within Queensland. According to paragraph (b) of the definition of 'patient contribution' in subsection 3(1), the Minister has the authority to determine these levels, and this determination sets the amount at $38.20 per day, effective from 20 March 2007. This adjustment applies exclusively to recognised hospitals in Queensland, marking a change in the financial obligations for patients in these facilities. The Act imposes specific obligations on recognised hospitals in Queensland to adhere to the newly set patient contribution rates. From the commencement date of 20 March 2007, these hospitals must charge nursing-home type patients the determined amount of $38.20 per day. This requirement ensures uniformity in the application of patient contribution rates across the state's recognised hospitals, streamlining the billing process and patient expectations. Failure to comply with the patient contribution rates set forth in this determination may have legal ramifications, although the specific offences, penalties, or consequences are not detailed in the provided text. Generally, under the Health Insurance Act 1973, breaches of the provisions could lead to civil or criminal penalties, depending on the nature and severity of the non-compliance. The Act is designed to maintain integrity in the healthcare system by ensuring that recognised hospitals adhere to the stipulated financial obligations for patient contributions.
