Overview

The Declaration of Quality Assurance Activity under section 124X of the Health Insurance Act 1973 — QAA No. 2/2010 was enacted to ensure that certain quality assurance activities are appropriately regulated under the Act. This legislative instrument was prepared under the authority of Nicola Roxon, the Minister for Health and Ageing, and it was introduced to address the need for oversight and regulation of specific quality assurance activities in the health sector. The objective of the declaration is to specify the activities that fall under the purview of Part VC of the Health Insurance Act 1973, ensuring that these activities are conducted by organisations authorised by associations of health professionals and that they are in the public interest. This declaration helps to maintain the quality and safety of health services provided in Australia, particularly in areas such as the accreditation of health services in Australian immigration detention centres and the accreditation of diagnostic imaging practices.

Scope and Application

The Declaration of Quality Assurance Activity under section 124X of the Health Insurance Act 1973—QAA No. 2/2010, as amended, outlines specific activities designated as quality assurance activities under Part VC of the Health Insurance Act 1973. This declaration applies to activities conducted by organisations authorised by an association of health professionals, ensuring that these activities are in the public interest and meet the criteria set forth in the Health Insurance Regulations 1975. The legislation applies to specific organisations, namely Quality Innovation Performance Limited and Australian General Practice Accreditation Limited (AGPAL), which are engaged in accreditation activities for health services in Australian immigration detention centres, diagnostic imaging practices, and general practices, including after-hours and medical deputising services. The geographic scope of this Act is national, given its alignment with the Health Insurance Act 1973, which operates across Australia. The Act does not specify exclusions or exemptions but is subject to modifications through subordinate instruments, as noted in the endnotes. The declaration's effect is confined to the described activities unless altered by subsequent legislative amendments.

Key Provisions

The key provisions of this legislative instrument relate to the declaration of specific quality assurance activities under section 124X of the Health Insurance Act 1973. The Minister for Health and Ageing, Nicola Roxon, declares that the activities listed in the Schedule are quality assurance activities to which Part VC of the Act applies. This declaration is made on the basis that the organisations engaging in these activities are authorised by an association of health professionals and that it is in the public interest for Part VC to apply to these activities, considering the criteria in the Health Insurance Regulations 1975. The declared activities include the accreditation of health services in Australian immigration detention centres, accreditation of diagnostic imaging practices, and accreditation for general practices, including after-hours and medical deputising services. These activities are to be conducted by Quality Innovation Performance Limited and Australian General Practice Accreditation Limited (AGPAL), and they aim to ensure that health services meet specific standards and deliver safe, high-quality care. The Minister's declaration serves to formalise these activities as quality assurance activities under the Act. Organisations involved in these quality assurance activities must comply with the requirements set out in the Health Insurance Act 1973 and the Health Insurance Regulations 1975. They must ensure that their activities are authorised by the relevant association of health professionals and that they adhere to the public interest criteria outlined in the regulations. Additionally, they must implement the accreditation processes as described in the Schedule to maintain the standards specified for each activity. Failure to comply with the requirements of the Health Insurance Act 1973 and the Health Insurance Regulations 1975 may result in civil or criminal penalties. The specific consequences and penalties depend on the nature and severity of the breach. Civil penalties can include fines, while criminal penalties can involve imprisonment or substantial fines, depending on the seriousness of the offence. The exact penalties are stipulated in the relevant sections of the Act and Regulations, but the document does not specify the maximum penalties. Legal recourse and enforcement mechanisms are available to address breaches and ensure compliance with the legislative requirements.
