Overview

The Horticulture Marketing and Research and Development Services Act 2000 was enacted to address the need for the efficient and effective marketing and research services for the horticulture industry in Australia. This Act was introduced by the Australian Parliament with the aim of supporting the growth and development of the horticulture sector through strategic research, marketing, and other development services. The policy objective of this Act is to enhance the competitiveness of the horticulture industry, ensuring that it can meet both domestic and international market demands. On 18 June 2020, Cassandra Kennedy, as a delegate of the Secretary of the Department of Agriculture, determined the Gross Value of Production (GVP) for the horticulture industry for the 2019-20 financial year. The GVP was determined to be $11,161,002,855, reflecting the significant economic contribution of the horticulture sector to the national economy. This determination is in accordance with the provisions of the Horticulture Marketing and Research and Development Services Act 2000, highlighting the ongoing commitment to support and develop the horticulture industry in Australia.

Scope and Application

The Horticulture Marketing and Research and Development Services Act 2000 applies to entities and individuals within the Australian horticulture industry, specifically targeting the marketing and research and development aspects of the industry. This legislation encompasses the determination and reporting of the Gross Value of Production (GVP) for the horticulture sector, which is essential for the formulation of policies, funding allocations, and strategic planning. The act's jurisdictional reach is nationwide, operating under the Commonwealth to ensure consistent and comprehensive oversight of the horticulture industry across all states and territories. The determination of GVP, such as the $11,161,002,855 for the 2019-20 period, is a critical function of this Act, ensuring accurate and timely data for economic analysis and industry support. While the primary focus of this legislation is on the collection and reporting of GVP, it does not detail specific exclusions or exemptions, though such details may be elaborated in subordinate instruments or regulations. This determination by Cassandra Kennedy, a delegate of the Secretary of the Department of Agriculture, is an exercise of powers granted under the Act, reflecting the importance of precise and reliable data in supporting the horticulture sector.

Key Provisions

The primary operative section of this Gazette (C2020G00571) is the determination by Cassandra Kennedy, a delegate of the Secretary of the Department of Agriculture, of the Gross Value of Production (GVP) for the horticulture industry for the financial year 2019-20. This determination (section 32(2) of the Horticulture Marketing and Research and Development Services Act 2000) specifies that the GVP for the horticulture industry for that period is $11,161,002,855 (subsection 16(7A) of the Act). This determination is crucial as it provides a benchmark for the financial health and performance of the horticulture industry within the specified financial year. The Act imposes specific obligations on the parties it governs. Firstly, it requires the Department of Agriculture to undertake the assessment and calculation of the Gross Value of Production for the horticulture industry. This assessment is to be conducted annually, ensuring that the figures provided are up-to-date and reflective of the current economic conditions within the industry. The delegate of the Secretary, in this case, Cassandra Kennedy, is tasked with making the final determination based on the collected data and analyses. This process ensures that the figures are accurate and are subject to official oversight, maintaining transparency and accountability within the industry. In terms of consequences for non-compliance or breach, the Gazette itself does not explicitly outline offences, penalties, or civil/criminal consequences. However, given the nature of the Horticulture Marketing and Research and Development Services Act 2000, it can be inferred that any misrepresentation or failure to accurately determine the Gross Value of Production could lead to legal repercussions. The Act likely includes provisions for penalties related to incorrect or manipulated data, ensuring the integrity of the reported figures. While the exact penalties are not detailed in the Gazette, they would typically be outlined in the relevant sections of the Act, potentially including fines or other administrative actions to correct the inaccuracies.
