Overview

The Egg Industry Service Provision Act 2002 was enacted to provide a framework for the service provision within the egg industry, addressing the need for a structured approach to service delivery and regulation in the sector. This Act was introduced by the Australian Parliament to ensure that the egg industry operates efficiently and meets the standards set forth by the government, thereby contributing to the broader agricultural economy. The policy objective of the Act is to facilitate the provision of services that support the production, marketing, and distribution of eggs, while also ensuring that the interests of consumers, producers, and other stakeholders are adequately protected. In accordance with this legislation, the Minister for Agriculture, Bridget McKenzie, determined the Gross Value of Production for the egg industry for the 2018-19 financial year, setting the industry GVP at $826,344,512. This determination was made under the authority of subsection 8(3) of the Act and was gazetted on 8 July 2019. This action reflects the government's commitment to providing accurate and up-to-date economic data that supports informed decision-making within the industry.

Scope and Application

The Gross Value of Production for the Egg Industry for 2018-19, as determined by the Minister for Agriculture under the Egg Industry Service Provision Act 2002, specifies the monetary value of all eggs produced in Australia for that financial year. The Act applies to the egg industry, including all entities and individuals engaged in the production, processing, and sale of eggs within the country. The geographic reach of this legislation is national, as it pertains to the entire Australian egg industry. The determination of the Gross Value of Production for the specified year is a crucial aspect of the statutory framework governing the industry, as it affects the allocation of funds and services provided under the Act. While the Act itself sets out the basis for determining the Gross Value of Production, it also allows for the extension or restriction of its application through subordinate instruments, ensuring the regulation remains flexible and responsive to industry needs. This determination by the Minister does not extend to other industries or commodities, thereby maintaining the specificity and focus of the Act on the egg industry alone. Any exclusions, exemptions, or thresholds are to be found within the broader legislative framework of the Egg Industry Service Provision Act 2002, which provides the detailed rules and conditions under which the industry operates. The Act ensures that the value of production is accurately assessed to appropriately fund services and initiatives that benefit the industry, reflecting the importance of precise and timely data in supporting regulatory and developmental objectives.

Key Provisions

The main operative section of this legislation, under subsection 8(3) of the Egg Industry Service Provision Act 2002, involves the determination of the Gross Value of Production (GVP) for the egg industry for the financial year 2018-19 (section 8(3)). This determination sets the GVP for the egg industry at $826,344,512. This determination is crucial as it provides a baseline figure for financial calculations and reporting within the industry, and it likely affects various financial obligations, subsidies, and reporting requirements for entities within the egg industry. The Act imposes specific obligations on the Minister for Agriculture, in this case, Bridget McKenzie, to make this determination annually based on the economic performance of the egg industry. The determination must be made in accordance with the provisions of the Act, ensuring that the figure reflects the true economic output of the industry for that financial year. This determination process is part of the regulatory framework designed to support the egg industry by providing accurate financial metrics that can be used in policy-making and economic planning. Failure to comply with the requirements of the Act, or if the determination is made in bad faith or without due consideration of the relevant data, could lead to legal consequences. While the specific legislative text does not detail offences, penalties, or consequences for breach, similar legislation often includes provisions for civil or criminal penalties for non-compliance. These could include fines, legal action to rectify the determination, or other administrative actions deemed necessary by the courts or regulatory bodies. The exact penalties would depend on the specific circumstances and the interpretation of the Act by the courts.
