Overview

The Gross Value of Production for the Egg Industry for 2017-18 was determined under the Egg Industry Service Provision Act 2002. This Act was enacted to provide a framework for the management of levies within the egg industry, ensuring that funds are appropriately collected and allocated to support the industry's service provision. The 2018 gazette, issued by David Littleproud, Minister for Agriculture and Water Resources, specifies the Gross Value of Production for the egg industry as $806,711,247 for the 2017-18 financial year. The determination of this figure is a critical step in the process of levy collection and service provision, aiming to maintain the viability and sustainability of the industry. The Egg Industry Service Provision Act 2002 was introduced to address the need for a structured approach to the collection and management of industry levies. By specifying the Gross Value of Production, the Act facilitates the equitable distribution of funds raised through levies, ensuring that the industry can continue to provide essential services. The determination of this value by the Minister is a statutory requirement under the Act, ensuring transparency and accountability in the process.

Scope and Application

The C2018G00561 (Gazette) is a notification under the Egg Industry Service Provision Act 2002, specifying the Gross Value of Production (GVP) for the egg industry for the financial year 2017-18. This determination applies to the egg industry within Australia, encompassing all entities involved in the production, processing, and marketing of eggs. The specified GVP of $806,711,247 reflects the economic value of the industry during that period. The legislation is issued by the Minister for Agriculture and Water Resources, David Littleproud, as required by the Act, and it sets the parameters for the financial obligations and levies applicable to industry participants. The Act's scope is confined to the egg industry and does not extend to other agricultural sectors. Any exclusions or exemptions are not specified in this notification but would typically be addressed in the primary Act or through subordinate instruments.

Key Provisions

The main operative section of this legislation is subsection 8(3) of the Egg Industry Service Provision Act 2002, which empowers the Minister for Agriculture and Water Resources to determine the Gross Value of Production (GVP) for the egg industry for a given financial year. In this case, the Minister has determined that the GVP for the 2017-18 financial year is $806,711,247 (subsection 8(3)). This determination is intended to provide a clear and accurate measure of the industry's economic output, which is crucial for various regulatory and policy-making purposes. The Act imposes an obligation on the Minister for Agriculture and Water Resources to determine the GVP for the egg industry each financial year, based on the available data and in accordance with the provisions of the Act. The Minister's determination of the GVP for 2017-18 is a formal and binding exercise of this obligation, which is intended to ensure that the industry's economic output is accurately measured and reported. There are no specific offences, penalties, or civil/criminal consequences for breach outlined in this legislation, as it primarily serves an administrative and informational function rather than a regulatory one. However, the accurate determination of the GVP is important for the proper functioning of the egg industry and the implementation of relevant policies and regulations. Inaccuracies or omissions in the GVP determination could potentially lead to regulatory or policy issues, but these are not explicitly addressed in the text of this legislation.
