Overview

The Gross Value of Production for the Dairy Industry for 2015-16 Act (C2016G00946), enacted in 2016, establishes the gross value of production for the dairy industry for the specified financial year. This legislation was introduced to provide a clear and official figure for the gross value of production within the dairy industry, thereby ensuring accurate and consistent data for research, development activities, and related purposes. Enacted by the Australian Government, the policy objective is to facilitate the efficient allocation of resources towards enhancing the dairy industry's research and development efforts, ultimately contributing to the industry's growth and sustainability.

Scope and Application

The Gross Value of Production for the Dairy Industry for 2015-16, as determined by the delegate of the Minister for Agriculture and Water Resources under the Dairy Produce Act 1986, applies specifically to entities within the dairy industry. This legislative instrument sets the gross value of production for the specified financial year, which is to be applied towards funding research and development activities within the industry. The determination of this value is integral to ensuring that the industry receives appropriate support for its research and development efforts, thereby contributing to the overall advancement and sustainability of the dairy sector. This legislative action is a Commonwealth-level determination, binding on all entities involved in the dairy industry across Australia, and it does not contain any exclusions, exemptions, or thresholds specified in this particular gazette. The application of this gross value of production is expected to be implemented through the mechanisms and regulations outlined in the Dairy Produce Act 1986, which may include subordinate instruments or further administrative actions to ensure compliance and effective allocation of funds.

Key Provisions

The legislation in question, C2016G00946, specifies the Gross Value of Production (GVP) for the dairy industry for the financial year 2015-16. This determination is made by Fran Freeman, a delegate of the Minister for Agriculture and Water Resources under the authority of the Dairy Produce Act 1986 (sections 10(1) and 6(4)). The GVP for the dairy industry has been set at $4,530,796,565, which is the amount deemed necessary for research and development activities within the industry (section 6(4)). This determination places a financial obligation on the dairy industry to contribute to research and development activities. This is essential for improving productivity, sustainability, and innovation within the sector. The Act ensures that the funds are directed towards activities that will benefit the entire industry, promoting better practices and enhancing the overall quality and competitiveness of dairy products in the market. Breaches or non-compliance with the provisions outlined in this legislation could lead to various consequences. While the specific penalties are not detailed in the provided text, it is reasonable to infer that any failure to adhere to the determined GVP or misuse of funds could result in legal action under the Act. The consequences could range from financial penalties to legal disputes over the allocation and use of funds, depending on the severity and nature of the breach. Given the structured nature of the Act, it is likely that there are formal processes in place for reporting and auditing the use of the GVP funds. These processes ensure transparency and accountability in how the funds are managed and spent, thereby maintaining the integrity of the research and development initiatives funded through this legislation. The importance of compliance cannot be overstated, as it directly impacts the effectiveness of the initiatives aimed at advancing the dairy industry. In summary, the legislation establishes a clear financial obligation for the dairy industry to contribute to research and development. It mandates a specific GVP amount for this purpose and implies a framework for compliance and potential consequences for non-compliance. The determination by Fran Freeman is a formal acknowledgment of the industry's financial responsibility, ensuring that the sector continues to evolve and improve through dedicated research and development efforts.
