Overview

The Greenhouse and Energy Minimum Standards (Exemption) Instrument (No. 2) 2024 was enacted to provide exemptions from certain requirements of the Greenhouse and Energy Minimum Standards (Household Refrigerating Appliances) Determination 2019 for specified models of refrigerators. This legislative instrument was made under subsection 37(1) of the Greenhouse and Energy Minimum Standards Act 2012 by the Australian Government, with the aim of addressing specific concerns or circumstances that warranted deviations from the general standards set forth in the Determination. The instrument identifies particular models that are exempt from the GEMS level, labelling, and other requirements, ensuring compliance with the broader policy objectives of promoting energy efficiency and reducing greenhouse gas emissions while accommodating particular market needs or technical considerations. This legislative instrument will be repealed 12 months after its commencement, reflecting its temporary nature and the intention to review and potentially revise the exemptions based on ongoing assessments of their impact and relevance. The detailed specifications of the exempt models and the exact nature of the exemptions are outlined in Schedule 1 of the instrument, providing clarity on which models are affected and the specific requirements from which they are exempt.

Scope and Application

The Greenhouse and Energy Minimum Standards (Exemption) Instrument (No. 2) 2024, made under the Greenhouse and Energy Minimum Standards Act 2012, pertains to the exemption of specific models of household refrigerating appliances from certain standards set by the Greenhouse and Energy Minimum Standards (Household Refrigerating Appliances) Determination 2019. This legislative instrument specifically exempts Asko brand refrigerators with the model number RFN31841I from compliance with the Greenhouse and Energy Minimum Standards (GEMS) level requirements, GEMS labelling requirements, and other GEMS requirements as outlined in parts 8, 9, and 10 of the Determination. The exemption applies to supplies of these refrigerators. The exemption is in effect for a period of twelve months following the instrument's commencement date of 24 August 2024. The instrument does not specify any exclusions or exemptions beyond the outlined scope and will be repealed one year after its commencement.

Key Provisions

The Greenhouse and Energy Minimum Standards (Exemption) Instrument (No. 2) 2024 (the Instrument) provides specific exemptions from certain energy efficiency standards set out in the Greenhouse and Energy Minimum Standards (Household Refrigerating Appliances) Determination 2019 (the Determination). This is detailed in sections 5 and 6 of the Instrument. Under section 5, the Instrument specifies which models are exempt from the Determination, and under section 6, it outlines the particular requirements of the Determination that the specified models are exempt from. For instance, the models exempted are the Asko RFN31841I, and they are exempt from the GEMS level requirements, GEMS labelling requirements, and GEMS other requirements as outlined in the Determination. The Instrument imposes obligations on parties or entities to comply with the exemptions as specified. For example, suppliers of the Asko RFN31841I refrigerator must ensure that these models are not subject to the energy efficiency standards outlined in the Determination. This is crucial for maintaining the integrity of the exemption and ensuring that the specified models are not misclassified or subjected to inappropriate regulatory requirements. There are potential consequences for breaching the provisions of the Instrument. Under the Greenhouse and Energy Minimum Standards Act 2012, non-compliance with the exemptions outlined in this Instrument could lead to enforcement actions. The Act includes provisions for penalties that could apply, although the exact nature and maximum penalties are not detailed within this particular Instrument. Generally, penalties for breaches of energy efficiency regulations can include fines and other civil or criminal sanctions, which are determined based on the severity and intent of the breach.
