OFFSHORE PETROLEUM JOINT AUTHORITY
Overview
The Offshore Petroleum and Greenhouse Gas Storage Act 2006 was enacted to provide a comprehensive legislative framework for the regulation of offshore petroleum and greenhouse gas storage activities in Australian waters. This Act was introduced to address the need for a coordinated approach to the management of offshore petroleum resources, ensuring both the sustainable development of these resources and the protection of the marine environment. The Act was enacted by the Parliament of Australia and aims to balance the economic benefits of offshore petroleum activities with environmental protection and safety considerations. It establishes the legislative foundation for the Commonwealth-Western Australia Offshore Petroleum Joint Authority, which is responsible for the administration and regulation of offshore petroleum activities within the joint authority area.
The grant of Petroleum Production Licence WA-64-L to Santos WA Northwest Pty Ltd, Santos WA Southwest Pty Limited and Carnarvon Energy Limited over Graticular Blocks 2577, 2578, 2649 and 2650 of the Map Sheet SE50 (Rowley Shoals) is a specific application of the Act. This licence allows the named entities to conduct petroleum production activities within the specified blocks, subject to the terms and conditions outlined in the licence and the broader provisions of the Act. The cessation of Petroleum Exploration Permit WA-437-P upon the grant of this production licence reflects the progression from exploration to production under the legislative scheme established by the Act.
Scope and Application
The Offshore Petroleum and Greenhouse Gas Storage Act 2006 applies to entities and persons involved in offshore petroleum activities and greenhouse gas storage within the Commonwealth, state, and territory waters of Australia. The Act provides a legislative framework for the regulation and administration of offshore petroleum exploration, production, and storage, ensuring sustainable and environmentally responsible practices. Specifically, section 708 of the Act pertains to the grant of petroleum production licences, which authorises the specified entities to engage in petroleum production activities within designated offshore blocks. The geographic scope of the Act encompasses the specific graticular blocks mentioned in the notice, namely Blocks 2577, 2578, 2649, and 2650 of Map Sheet SE50, which are located in the Rowley Shoals region. The licence granted under the Act to Santos WA Northwest Pty Ltd, Santos WA Southwest Pty Limited, and Carnarvon Energy Limited is effective from 7 April 2022, marking the transition from the previous Petroleum Exploration Permit WA-437-P. The Act does not explicitly outline exclusions, exemptions, or thresholds, but it is understood that subordinate instruments and regulations may provide further clarification on the application and implementation of the Act.
Key Provisions
The Offshore Petroleum and Greenhouse Gas Storage Act 2006 (sections 471 and 708) provides the legislative framework for the grant of petroleum production licences and the administration of offshore petroleum activities. Specifically, section 708 allows for the grant of a life-of-field Petroleum Production Licence, which in this case is Licence WA-64-L. This licence has been granted to Santos WA Northwest Pty Ltd, Santos WA Southwest Pty Limited, and Carnarvon Energy Limited for Graticular Blocks 2577, 2578, 2649, and 2650 of the Map Sheet SE50 (Rowley Shoals), effective from 7 April 2022. Concurrently, the existing Petroleum Exploration Permit WA-437-P for the same blocks ceases to be in force upon the issuance of this new licence.
The grant of Licence WA-64-L imposes several obligations and requirements on the licensees. These entities must adhere to all provisions of the Offshore Petroleum and Greenhouse Gas Storage Act 2006, ensuring compliance with environmental, safety, and operational standards. The licensees are responsible for conducting their offshore petroleum activities in a manner that minimises environmental impact and adheres to the regulatory requirements set forth by the Commonwealth–Western Australia Offshore Petroleum Joint Authority. Additionally, they must keep detailed records of their activities and report any incidents or significant findings to the relevant authorities as stipulated by the Act.
Failure to comply with the Act's provisions can result in significant consequences. Breaches of the Act may lead to administrative actions, including the revocation or suspension of the licence, as well as fines and other penalties. The Act does not specify maximum penalties within the gazetted notice, but it is known that severe non-compliance could lead to criminal charges under other sections of the Act, potentially resulting in substantial fines and imprisonment. Civil liabilities may also arise for any damages caused by non-compliance, further emphasising the importance of adhering to the legislative requirements.
