Overview
The Commonwealth of Australia has enacted the Commonwealth of Australia Constitution Act, which was originally enacted in 1900 and amended in 1986 to rectify various constitutional deficiencies and to ensure the smooth operation of the federal system of government. This Act was introduced by the Parliament of the Commonwealth of Australia with the policy objective of establishing a federal constitutional monarchy with a parliamentary system of government, which includes the separation of powers between the legislative, executive, and judicial branches. The Act provides the framework for the creation and functioning of the Commonwealth of Australia, its government institutions, and the allocation of powers between the states and the federal government.
The Act was proclaimed by Sam Mostyn, who was appointed as the Governor-General of the Commonwealth of Australia on 1 July 2024. This appointment was made by His Majesty King Charles the Third under the Great Seal of Australia and followed by a proclamation by Sam Mostyn, affirming their allegiance and assuming office in accordance with the Act. The Governor-General plays a crucial role in the formal aspects of government, including the opening and closing of parliamentary sessions, the granting of royal assent to legislation, and the appointment of the Prime Minister and other ministers.
Scope and Application
The C2024G00396 Proclamation, dated 1 July 2024, pertains to the appointment of Sam Mostyn as the Governor-General of the Commonwealth of Australia, a role appointed by His Majesty King Charles the Third. This Act applies to Sam Mostyn as an individual, confirming her appointment and the subsequent affirmation of allegiance and office she has made before the Chief Justice of Australia. The geographic and jurisdictional reach of this Act is national, encompassing the Commonwealth of Australia. The proclamation does not detail specific exclusions, exemptions, or thresholds applicable to the role of the Governor-General, nor does it extend or restrict the application through subordinate instruments. It primarily serves as a formal record of the appointment and the formalities observed in the assumption of office.
Key Provisions
The main sections of the proclamation C2024G00396 detail the formal process through which Samantha Joy Mostyn has been appointed as the Governor-General of the Commonwealth of Australia (s. 2). This proclamation confirms that Ms. Mostyn has made the required affirmations of allegiance and office, which are the prescribed steps for assuming the office (s. 3). It also notes that these affirmations were made in the presence of the Honourable the Chief Justice of Australia, as mandated by the constitution (s. 4).
The proclamation imposes specific obligations on Ms. Mostyn as the newly appointed Governor-General. Primarily, she is required to make the prescribed affirmations before the Chief Justice, as outlined in section 3 of the proclamation. Additionally, she must assume the office in accordance with the affirmations made, signifying her formal acceptance of the role (s. 5). These steps are critical in legally validating her position and the authority she holds as Governor-General.
There are no offences, penalties, or civil/criminal consequences explicitly stated in this proclamation for failing to adhere to its provisions. The proclamation itself is a formal declaration of the completion of necessary legal steps for the appointment and assumes that such steps will be followed as a matter of constitutional duty. Therefore, any failure to make the required affirmations or to assume the office correctly would likely be addressed through constitutional or judicial processes rather than through specific penalties outlined in this document.
