Overview
The Australian Government Gazette No. G56, dated 30 May 2019, details the appointment and subsequent assumption of office of the Governor-General of the Commonwealth of Australia, David John Hurley. This proclamation follows the appointment by Her Majesty Queen Elizabeth the Second, who, through a Commission under Her Royal Sign Manual and the Great Seal of Australia, has appointed Mr. Hurley to the role. The enactment of this appointment is to ensure a seamless transition and continuity in the leadership of the nation's highest constitutional office. The Governor-General is a key figure in the Australian system of government, representing the Crown and performing various ceremonial, executive, and reserve powers as outlined in the Constitution. The proclamation signifies Mr. Hurley's formal acceptance of the office, including taking the prescribed oath of allegiance and the oath of office before the Honourable the Chief Justice of Australia. This process underscores the importance of the office in maintaining the constitutional framework and the rule of law in Australia.
Scope and Application
The Proclamation C2019G00567, dated 1 July 2019, serves to document the formal appointment and swearing-in of David John Hurley as the Governor-General of the Commonwealth of Australia. This Act applies to David Hurley, a person who has been appointed by Her Majesty Queen Elizabeth the Second to the role of Governor-General, and it pertains to the solemn oaths of allegiance and office he has taken before the Honourable the Chief Justice of Australia. The scope of this proclamation is national, extending throughout the Commonwealth of Australia, and it is rooted in the constitutional framework that governs the appointment and duties of the Governor-General. The Act itself does not provide for any exclusions or exemptions, as it merely records the procedural steps undertaken for the assumption of this high office. The proclamation does not extend its application through subordinate instruments but rather stands as a formal declaration of the Governor-General’s assumption of office.
Key Provisions
The main operative sections of the Proclamation (C2019G00567) are straightforward and focus on the formal process of the Governor-General's appointment and swearing-in. Section 1 declares the appointment of David John Hurley as the Governor-General of the Commonwealth of Australia by Queen Elizabeth II. This section signifies the commencement of his official duties as the nation's representative of the Crown. Section 2 details the Governor-General's assumption of office, which includes taking the prescribed oath of allegiance and the oath of office before the Honourable Chief Justice of Australia. This oath-taking ceremony is a crucial step in the formal transition into the role, ensuring that the Governor-General is bound by the duties and responsibilities outlined in the Constitution.
The Act imposes several obligations on the parties involved, particularly on David John Hurley as the appointed Governor-General. Firstly, he must make the prescribed oath of allegiance and the prescribed oath of office before the Chief Justice of Australia. This requirement ensures that the Governor-General publicly affirms their loyalty to the Crown and commitment to upholding the Constitution and the laws of Australia. Additionally, the Chief Justice plays a pivotal role in overseeing the oath-taking ceremony, which is a ceremonial and legal necessity for the Governor-General to assume office.
Breaching the requirements set out in the Proclamation can have significant consequences. Although the Proclamation itself does not specify particular offences or penalties, the failure to take the prescribed oaths and assume the office as mandated can be seen as a dereliction of duty. This could lead to legal and constitutional complications, potentially resulting in the invalidation of the Governor-General's appointment. The broader implications might include a vacancy in the office of the Governor-General, which could disrupt governmental operations and constitutional governance. However, the specific legal ramifications and any applicable penalties would likely be addressed in other related statutes or common law principles.
