Overview

The General Insurance Supervisory Levy Regulations were enacted in 1990 under the General Insurance Supervisory Levy Act 1989, serving to regulate the supervisory levy applied to the general insurance sector. These regulations were established to address the need for a dedicated funding mechanism to support the supervision and regulation of general insurance entities in Australia. The enabling legislation of this Statutory Rules was repealed by Act No. 54 of 1998, but the regulations themselves have been maintained and updated through subsequent statutory rules. The primary policy objective of these regulations is to ensure that sufficient funds are available for the Australian Prudential Regulation Authority (APRA) to effectively supervise and regulate the general insurance industry, thereby protecting policyholders and maintaining market stability. The General Insurance Supervisory Levy Regulations specify the annual rate of the general insurance levy applicable to a leviable day, which, as of the most recent amendment in 1994, stands at $16,300. These regulations were prepared by the Office of Legislative Drafting, Attorney-General’s Department, and are intended to provide clear and precise guidelines for the implementation of the levy, ensuring compliance and effective oversight within the general insurance sector.

Scope and Application

The General Insurance Supervisory Levy Regulations, which were made under the General Insurance Supervisory Levy Act 1989, apply to entities involved in the general insurance industry in Australia. These regulations specify the annual rate of the levy, which is a financial charge imposed on authorised insurers and certain other entities to fund the Australian Prudential Regulation Authority's supervision of the insurance industry. The Regulations came into effect on 1 July 1990, and as of the date of this document, the applicable annual rate is $16,300 per leviable day. The regulations extend their reach across the entire Commonwealth, thereby affecting all authorised insurers and relevant entities operating within Australia. The enabling legislation for these regulations was repealed by Act No. 54 of 1998, although the regulations themselves remain in force and can be further modified or amended through subordinate instruments.

Key Provisions

The General Insurance Supervisory Levy Regulations, made under the General Insurance Supervisory Levy Act 1989, provide the framework for levying a supervisory fee on the general insurance industry in Australia. The regulations specify the annual rate of this levy, which is applicable to each leviable day (Section 3). As of the most recent amendment, the annual rate is set at $16,300 (Note to Section 3). These Regulations came into effect on 1 July 1990 (Section 2), and any subsequent amendments, such as those made in 1994, followed specific commencement dates to ensure a smooth transition. Entities subject to these regulations are required to comply with the prescribed annual rate of the general insurance levy. This levy is a financial obligation imposed on certain entities within the general insurance sector to support the costs associated with the supervision and regulation of the industry. The levy is calculated based on the number of leviable days, which are defined within the enabling legislation but not detailed in these regulations. The primary requirement for these entities is to ensure that they are aware of their obligation to pay the levy and to do so in accordance with the stipulated annual rate. Failure to comply with the payment requirements stipulated in the General Insurance Supervisory Levy Act and these Regulations can result in legal consequences. Although the specific penalties are not detailed in the regulations, breaches of the enabling Act may attract fines and other penalties as prescribed under that Act. The precise nature and extent of these penalties would be governed by the provisions of the General Insurance Supervisory Levy Act 1989, which provides the overarching legal framework for these Regulations. The regulatory and compliance burden on entities is to ensure timely and accurate payment of the supervisory levy, with the risk of incurring fines or other sanctions for non-compliance.
