Flexible Care Subsidy Amendment Principles 1998 (No. 1)
I, WARWICK leslie SMITH, Minister for Family Services, make the following principles under subsection 96-1 (1) of the Aged Care Act 1997.

1. Name of principles
1.1 These principles are the Flexible Care Subsidy Amendment Principles 1998 (No. 1).
2. Commencement
2.1 These principles commence on gazettal.
3. Amendment
3.1 The Flexible Care Subsidy Principles 19971 are amended as set out in these principles.
4. Section 15.3 (Definitions)
4.1 Definition of home nursing care package:
Omit the definition.
4.2 Insert the following definition:
“extended aged care at home package has the meaning given by subsection 15.6 (2).”.
5. Chapter 2 (Home nursing care packages)
5.1 Omit the Chapter heading, substitute:
“Chapter 2 — Extended aged care at home packages”.
6. Section 15.5 (Purpose of Part (Act, s 50-2))
6.1 Omit “home nursing care packages.”, substitute “extended aged care at home packages.”.
7. Section 15.6 (Application for approval — extended aged care at home packages)
7.1 Subsection 15.6 (1):
Omit “home nursing care packages.”, substitute “extended aged care at home packages.”.
7.2 Subsection 15.6 (2):
Omit “A home nursing care package”, substitute “An extended aged care at home package”.
7.3 Paragraph 15.6 (3) (e):
Omit “home nursing care packages;”, substitute “extended aged care at home packages;”.
8. Section 15.7 (Considering application)
8.1 Paragraph 15.7 (1) (d):
After “number”, insert “of”.
9. Section 15.10 (Kind of care)
9.1 Omit “a home nursing care package.”, substitute “an extended aged care at home package.”.
10. Section 15.11 (Purpose of Part (Act, s 51-1))
10.1 Omit “home nursing care packages.”, substitute “extended aged care at home packages.”.
11. Section 15.12 (Payment agreement)
11.1 Paragraph 15.12 (e):
Omit the paragraph, substitute:
“(e) the number of places providing a high level of residential care that will be converted to provide flexible care in the form of an extended aged care at home package;”.
11.2 Subparagraph 15.12 (m) (i):
Omit “home nursing care package”, substitute “extended aged care at home package”.
11.3 Subparagraph 15.12 (m) (ii):
Omit the subparagraph.
11.4 After paragraph 15.12 (m), insert:
“; (n) the amount of care recipient contribution the approved organisation can charge.”.
