Overview

Statutory Rules 1976 No. 173, made under the Fisheries Act 1952, introduces amendments to the Fisheries Regulations. Enacted by the Governor-General of the Commonwealth of Australia, acting on the advice of the Federal Executive Council, these regulations seek to streamline and modernise existing administrative practices within the fisheries sector. This legislative instrument was introduced to address discrepancies and outdated references within the Fisheries Regulations, ensuring consistency and clarity in the application of fees and definitions. The policy objective is to facilitate smoother operations and compliance within the fisheries industry by updating regulatory language and numerical references to align with contemporary standards and practices.

Scope and Application

The Statutory Rules 1976 No. 173, which amend the Fisheries Regulations, apply to all individuals, entities, and vessels engaged in fishing activities within Australian waters, including Commonwealth waters, state waters, and territorial waters. This legislative instrument serves to update and refine the regulatory framework established under the Fisheries Act 1952, ensuring that licensing, fees, and operational guidelines are consistently applied across various fishing sectors. The amendments include changes to fee structures, regulatory definitions, and specific operational requirements, with the intention of streamlining administrative processes and enhancing compliance. Notably, these regulations do not apply to certain types of vessels such as tuna long-line vessels, as specified in the amendments to the Schedule. Additionally, certain exclusions and thresholds that were previously outlined in sub-regulations have been removed or adjusted to reflect current practices and standards. These regulations are enforceable throughout the Commonwealth, state, and territorial waters of Australia, with the potential for further elaboration or restriction through subordinate instruments.

Key Provisions

The Statutory Rules 1976 No. 173 made under the Fisheries Act 1952 primarily revise existing regulatory structures and fees for the management of fisheries. The regulations include amendments to Regulation 10 of the Fisheries Regulations, which streamline the sub-regulations by removing redundant text and references (Regulation 10(1)). Furthermore, the Schedule to the Fisheries Regulations is modified to remove exclusions for certain types of boats, specifically those known as "tuna long-line vessels" (Schedule, item 2(d)), and to eliminate an additional paragraph in item 2 (Schedule, item 2(e)). Additional amendments are made to various provisions of the Fisheries Regulations, such as updating the date reference from "the first day of January, 1955" to "1 January 1955" (Regulation 2) and adjusting several definitions and fee structures to reflect current monetary values and regulatory references (Regulations 3, 8(4), 10(1), 10(2), 11(2), 12(1), 13(2), 14(1), 14(2), 15, 16, 17, 18, and Schedule). These amendments impose clear obligations on the parties involved in the fisheries sector. The revised regulatory framework ensures that all stakeholders, including licence holders and other relevant entities, adhere to updated fee structures and regulatory references. For example, the streamlined sub-regulations in Regulation 10(1) require parties to follow a more concise set of rules, while the changes in the Schedule necessitate compliance with broader regulatory oversight. These updates are essential for maintaining the integrity of the fisheries management system, ensuring that all activities are conducted within the bounds of the law. In terms of compliance, the Act sets out specific offences and penalties for non-compliance with the regulations. While the specific penalties are not detailed in the provided text, it is reasonable to infer that breaches of these regulations could lead to enforcement actions under the Fisheries Act 1952. Penalties may include fines, which could vary depending on the nature and severity of the offence. Given the amendments to fee structures, non-payment or underpayment of fees could result in financial penalties, while failure to comply with the updated regulatory requirements might lead to additional administrative or legal consequences.
