EXPLANATORY STATEMENT

STATUTORY RULES 1989 NO. 211

Issued by the authority of the Minister for Primary Industries and Energy.

FISHERIES LEVY ACT 1984

FISHERIES LEVY (WESTERN DEEP-WATER TRAWL

FISHERY) REGULATIONS (AMENDMENT)

Paragraph 5(b) of the Fisheries Levy Act 1984 (‘the Act’) provides for the imposition of levy upon the endorsement, under the Fisheries Act 1952 of a fisheries licence, being a class of endorsements prescribed for the purposes of that paragraph.

Management costs for the Western Deep-water Trawl Fishery (WDWTF) are recoverable through levy imposed under the Act. The amount of levy is calculated by dividing the management costs for the fishery by the number of endorsements to be issued in accordance with the WDWTF Development plan, approved by an industry/government advisory committee and the Minister for Primary Industries and Energy.

The Regulations specify $3,700 as the amount of levy for the 1989/90 season in respect of each endorsement of a fisheries licence authorising fishing in the WDWTF.

The increased levy is because of the decline in the number of endorsement holders in the fishery from 20 to 10 and analysis of catch reports for the fishery will no longer be funded by the Fishing Industry Research and Development Council. The Council’s policy is to fund developing fisheries. The Western Deep-water Trawl Fishery is now in its third year and is no longer considered a developing fishery.

The regulations will take effect on Gazettal.
