Financial Sector (Collection of Data) Determinations Nos. 65 to 104 of 2005 – reporting standards applying to authorised deposit-taking institutions

EXPLANATORY STATEMENT

Issued by the authority of the Australian Prudential Regulation Authority (‘APRA’)

Financial Sector (Collection of Data) Act 2001 (FSCOD Act’), s13(1)(a) and s 15

Acts Interpretation Act 1901, s 33(3)

Subsection 13(1) of the FSCOD Act provides that APRA may, by writing, determine reporting standards that are required to be complied with by financial sector entities.  Section 15 of the FSCOD Act gives APRA power to make a formal declaration of the date when reporting standards begin to apply.  (Although s 15(2) provides for such declarations to be published in the Gazette, s 56(1) of the Legislative Instruments Act 2003 provides that this requirement is fulfilled by registration on the Federal Register of Legislative Instruments.)  Subsection 33(3) of the Acts Interpretation Act gives APRA power to revoke reporting standards so made.  

Financial Sector (Collection of Data) Determinations Nos 65 to 103 of 2005 determine reporting standards which will apply to authorised deposit-taking institutions or ADIs (within the meaning of the Banking Act 1959).   Determination No. 104 of 2005 revokes certain old reporting standards, which the new ones replace.  The new reporting standards are substantially in the same form as the old ones.

Remaking these reporting standards will simplify compliance with the Legislative Instruments Act 2003. That Act requires Commonwealth agencies to back capture delegated legislation for which they are responsible on the Federal Register of Legislative Instruments.  Prior to the enactment of the Legislative Instruments Act, APRA generally made reporting standards by way of a single determination covering an entire series of reporting standards. Thus the principal instrument for back capture would comprise multiple reporting standards and forms running to hundreds of pages. For back capturing purposes, a legislative instrument of this size would be unwieldy and need to be broken up into several electronic files.  APRA has decided to remake the reporting standards, in substantially the same form, but with an individual determination for each reporting standard.  This will simplify the future revocation or amendment of individual reporting standards and the preparation of compilations, as well as avoid the need to back capture the replaced standards as a cumbersome electronic file.

The new reporting standards will formally begin to apply (under s 15 of the FSCOD Act) from the date of registration on the Federal Register of Legislative Instruments.  A new reporting standard will require a return to be lodged in respect of a reporting period where the date for lodgement under the new reporting standard is a day after the date of registration of the standard on the Federal Register of Legislative Instruments. So, for example, if a new reporting standard requires an ADI to lodge a quarterly return 25 business days after the end of the quarter, and the quarter for an ADI ends on 30 June, then the ADI will be required to lodge under the new reporting standard (assuming the new reporting standard is registered before the expiry of 25 days from 30 June 2005).  As the reporting requirements and times under each old and corresponding new standard are substantially identical it will not, in practice, matter if an ADI inadvertently refers to one of the old forms or standards when reporting during this transitional phase. 

Each old reporting standard will be revoked on the date the new standard replacing it comes into effect. However, this will be without prejudice to any obligation to lodge an overdue return under an old reporting standard. 

Financial Sector (Collection of Data) Determination No. 65 of 2005: Reporting Standard ARS 110.0 (2005)

Data supplied under this reporting standard will be used by APRA to assess an ADI’s compliance with the capital adequacy requirements of Prudential Standard APS 111 Capital Adequacy: Measurement of Capital.  Information in the return will be tracked over reporting periods to analyse/highlight any material shift in the capital structure.

Financial Sector (Collection of Data) Determination No. 5 of 2004 varied the original ARS 110.0 (which had come into effect on 1 July 2002) to substitute a new reporting form, which changes reporting requirements for ADIs concerning asset revaluation reserves and intangible assets. ARS 110.0 (2005) incorporates this new form.

The only material difference between the new reporting standard and the old reporting standard (as amended) is in the clause (made in accordance with paragraph 13(2)(f) of the FSCOD Act) permitting the adjustment of reporting periods.  The old clause required APRA to take into account prudential matters and the circumstances of the ADI (without precluding the taking into account of other relevant considerations) in varying a reporting period.  The new clause specifically requires APRA to take into account the requirements of the Australian Bureau of Statistics and the Reserve Bank of Australia.  This reflects the fact that data collected under the reporting standards may be used by those agencies for statistical purposes or in the formulation of monetary policy.  It should be noted that any decision APRA makes will need to weigh up relevant considerations for and against any change to a reporting period.

Financial Sector (Collection of Data) Determination No. 66 of 2005: Reporting Standard ARS 112.1 (2005)

Data supplied under this reporting standard will be used by APRA to determine an ADI’s compliance with the capital adequacy requirements imposed by APS 112 and to analyse movements in the on-balance sheet asset risk weighting profiles and ultimately the impact on the capital adequacy ratios of an ADI.

The clause permitting the adjustment of reporting periods has been amended in the way noted above in relation to ARS 110.0, to require APRA to consider the data requirements of the Australian Bureau of Statistics and the Reserve Bank.  Otherwise the new standard substantially reflects the one it replaces.

Financial Sector (Collection of Data) Determination No. 67 of 2005: Reporting Standard ARS 112.2 (2005)

Data supplied under this reporting standard will give APRA a greater appreciation and scope for analysis of the nature and level of the derivative products and other off-balance sheet exposures, used by an ADI in its trading and banking activities.  In addition, this return is required by Prudential Standard APS 112 – Capital Adequacy:  Credit Risk, for the calculation of off-balance sheet risk weighting and capital adequacy.

Financial Sector (Collection of Data) Determination No. 5 of 2004 varied the original ARS 112.2 (which had come into effect on 1 July 2002), to substitute a new form which will clarify reporting requirements for ADIs concerning non-market related off-balance sheet transactions.  ARS 112.2 (2005) incorporates this new form.

The clause permitting the adjustment of reporting periods has been amended in the way noted above in relation to ARS 110.0, to require APRA to consider the data requirements of the Australian Bureau of Statistics and the Reserve Bank.  Otherwise the new standard substantially reflects the one it replaces.

Financial Sector (Collection of Data) Determination No. 68 of 2005: Reporting Standard ARS 113.0 (2005)

Data collected under this reporting standard will be used by APRA to gauge the risk profile of trading activities and compliance with Prudential Standard APS 113 Capital Adequacy – Market Risk.

The clause permitting the adjustment of reporting periods has been amended in the way noted above in relation to ARS 110.0, to require APRA to consider the data requirements of the Australian Bureau of Statistics and the Reserve Bank.  Otherwise the new standard substantially reflects the one it replaces.

Financial Sector (Collection of Data) Determination No. 69 of 2005: Reporting Standard ARS 113.1 (2005)

Data collected under this reporting standard gives APRA a high level picture of the repricing profile of assets and liabilities and selected off-balance sheet exposures and commitments as required by Prudential Standard APS 113 Capital Adequacy – Market Risk.  In addition, as APRA does not currently collect any specific information on the sensitivity of an ADI’s balance sheet to interest rate risk, this information will form part of a basis of analysis for this purpose and may be used to focus on-site supervision.

Financial Sector (Collection of Data) Determination No. 70 of 2005: Reporting Standard ARS 210.0 (2005)

The purpose of this standard is to gain a liquidity profile of an ADI and to calculate its compliance with the minimum liquidity holding required for Prudential Standard APS 210 Liquidity.

The clause permitting the adjustment of reporting periods has been amended in the way noted above in relation to ARS 110.0, to require APRA to consider the data requirements of the Australian Bureau of Statistics and the Reserve Bank.  Otherwise the new standard substantially reflects the one it replaces.

Data collected under this reporting standard will be used by APRA to monitor compliance with Prudential Standard APS 220 Credit Quality and to gauge the general level of asset impairment.  Information will be tracked over reporting periods to highlight emerging trends or shifts in the level and profile of asset impairment.  This return may be used to facilitate targeting of the on-site supervision of APRA.

Data collected under this reporting standard will be used by APRA to monitor the general level of asset impairment and to monitor compliance with Prudential Standard APS 220 Credit Quality.  Information will be tracked over reporting periods to highlight emerging trends or shifts in the level and profile of asset impairment.  This return may be used to facilitate targeting of the on-site supervision of APRA.

Data collected under this reporting standard will be used by APRA to track movements in provisioning for impaired assets over reporting periods to highlight emerging trends or shifts in the level and profile of asset impairment thus monitoring compliance with Prudential Standard APS 220 Credit Quality.

Financial Sector (Collection of Data) Determination No. 74 of 2005: Reporting Standard ARS 221.0 (2005)

Data collected under this reporting standard will be used by APRA to gauge the amount and profile of significant exposures to related counterparties of the ADI and to monitor compliance with Prudential Standard APS 221 Large Exposures.

Financial Sector (Collection of Data) Determination No. 5 of 2004 varied the original ARS 221.0 (which had come into effect on 1 July 2003) to substitute a new reporting form, which clarified reporting requirements for credit unions and building societies concerning their on-balance sheet exposures.  ARS 221.0 (2005) incorporates this new form.

The clause permitting the adjustment of reporting periods has been amended in the way noted above in relation to ARS 110.0, to require APRA to consider the data requirements of the Australian Bureau of Statistics and the Reserve Bank.  Otherwise the new standard substantially reflects the one it replaces.

Financial Sector (Collection of Data) Determination No. 75 of 2005: Reporting Standard ARS 222.0 (2005)

Data collected under this reporting standard will be used by APRA to analyse an ADI’s exposures to individual counterparties that are related to that ADI and to monitor compliance with Prudential Standard APS 222.0 Equity Associations.  This information forms part of APRA’s monitoring and analysis framework for individual ADIs and the industry as a whole.

Financial Sector (Collection of Data) Determination No. 76 of 2005: Reporting Standard ARS 230.0 (2005)

Data collected under this reporting standard will be used by APRA to gauge exposure to the commercial property market by sector definition and the level of impairment.

Financial Sector (Collection of Data) Determination No. 77 of 2005: Reporting Standard ARS 231.1a (2005)

This reporting standard collects data on the gross financial claims (assets) of banks resident in Australia.  This data will be used to provide information on the role of banks and financial centres in the intermediation of international capital flows.

Financial Sector (Collection of Data) Determination No. 78 of 2005: Reporting Standard ARS 231.1b (2005)

This reporting standard collects data on the gross financial liabilities of banks resident in Australia.  This data will be used to provide information on the role of banks and financial centres in the intermediation of international capital flows.

Financial Sector (Collection of Data) Determination No. 79 of 2005: Reporting Standard ARS 231.2 (2005)

This reporting standard collects a similar range of data as above in ARS 231.1a and 231.1b but regroups the data in different ways. This data will be used to provide information on the role of banks and financial centres in the intermediation of international capital flows.

Financial Sector (Collection of Data) Determination No. 80 of 2005: Reporting Standard ARS 231.3a (2005)

This reporting standard collects data on domestically owned banks’ international financial claims (i.e. contractual lending) vis-à-vis the rest of the world and provides a measure of the risk exposure of Australia’s banking system.

Financial Sector (Collection of Data) Determination No. 81 of 2005: Reporting Standard ARS 231.3b (2005)

This reporting standard collects data on foreign owned banks’ international financial claims (i.e. contractual lending) vis-à-vis the rest of the world and provides a measure of the risk exposure of Australia’s banking system.

This reporting standard will collect data concerning claims on, and liabilities to, related parties of an ADI.

Financial Sector (Collection of Data) Determination No. 89 of 2005: Reporting Standard ARS 321.0 (2005)

This reporting standard will collect data on ADIs’ risk profile, growth and diversification in balance sheet structure and business (domestically).  Each classification in the return will be used for specific analysis in APRA’s analysis framework and will also be tracked over reporting periods.

Financial Sector (Collection of Data) Determination No. 90 of 2005: Reporting Standard ARS 325.0 (2005)

Data collected under this reporting standard will be used by APRA to provide a broad profile of the institutions’ international operations.

Financial Sector (Collection of Data) Determination No. 91 of 2005: Reporting Standard ARS 326.0 (2005)

This reporting standard collects data on the assets and liabilities of offshore banking units of an ADI.  Data collected under this reporting standard will be used by APRA for prudential supervision purposes.

Financial Sector (Collection of Data) Determination No. 92 of 2005: Reporting Standard ARS 330.0 (2005)

Data collected under this reporting standard will be used by APRA to enhance its understanding of the broad profile of the profitability and movements in interest margin, contribution of strategic investments and the existence of any extraordinary transactions impacting profitability.  The ABS will also use this information for production of the Australian National Accounts.

Financial Sector (Collection of Data) Determination No. 93 of 2005: Reporting Standard ARS 330.1 (2005)

Data collected under this reporting standard will be used to enhance APRA’s understanding of the profile and diversification of interest income and expense of the individual ADI, and the nature and contribution of group entity transactions. This updated information will also be used by the ABS for production of the Australian National Accounts.

The clause permitting the adjustment of reporting periods has been amended in the way noted above in relation to ARS 110.0, to require APRA to consider the data requirements of the Australian Bureau of Statistics and the Reserve Bank.  Otherwise the new standard substantially reflects the one it replaces.

Financial Sector (Collection of Data) Determination No. 94 of 2005: Reporting Standard ARS 330.2 (2005)

Data collected under this reporting standard will be used as an integral component of APRA’s off-site monitoring and analysis framework and will be used to enhance APRA’s understanding of the nature, diversification and contribution of non-interest income and contribution of group entity transactions.  In addition, this return permits APRA to consider return/profit in the analysis of risk.  It will also be used by the ABS for production of the Australian National Accounts.

The clause permitting the adjustment of reporting periods has been amended in the way noted above in relation to ARS 110.0, to require APRA to consider the data requirements of the Australian Bureau of Statistics and the Reserve Bank.  Otherwise the new standard substantially reflects the one it replaces.

Financial Sector (Collection of Data) Determination No. 95 of 2005: Reporting Standard ARS 330.3 (2005)

Data collected under this reporting standard will be used to enhance APRA’s understanding and analysis of the profile (and changes) of major components of non-interest expense, contribution of group entities and the amount of non-cash expenses.  It may also be used to gauge any potential shifts in the structure of the ADI’s operations.  It will also be used by the ABS for production of the Australian National Accounts.

The purpose of this reporting standard is to provide a greater amount of detail about particular data items, which will assist both APRA for prudential supervision purposes, and the ABS for use in the production of the Australian National Accounts.

Financial Sector (Collection of Data) Determination No. 98 of 2005: Reporting Standard ARS 391.0 (2005)

The purpose of this reporting standard is to provide monthly statistics on commercial finance provided to private and public sector businesses.  The statistics are used by APRA for prudential supervision purposes and may be used by the RBA and ABS for policy and statistical purposes.

The clause permitting the adjustment of reporting periods has been amended in the way noted above in relation to ARS 110.0, to require APRA to consider the data requirements of the Australian Bureau of Statistics and the Reserve Bank.  Otherwise the new standard substantially reflects the one it replaces.

Financial Sector (Collection of Data) Determination No. 99 of 2005: Reporting Standard ARS 392.0 (2005)

The purpose of this reporting standard is to provide monthly statistics on the provision of secured housing finance to individuals for owner occupied housing.  The statistics are used by APRA for prudential supervision purposes and may be used by the RBA and ABS for policy and statistical purposes. 

The clause permitting the adjustment of reporting periods has been amended in the way noted above in relation to ARS 110.0, to require APRA to consider the data requirements of the Australian Bureau of Statistics and the Reserve Bank.  Otherwise the new standard substantially reflects the one it replaces.

Financial Sector (Collection of Data) Determination No. 103 of 2005: Reporting Standard ARS 396.0 (2005)

The purpose of this reporting standard is to collect information which is required by Treasury about the type and locality of service delivery channels, or ‘points of presence’ for ADIs within Australia.

Financial Sector (Collection of Data) Determination No. 5 of 2004 varied the original ARS 396.0 (which had come into effect on 1 July 2002) to substitute a new reporting form, which changed reporting requirements concerning the type and locality of service delivery channels within Australia for all ADIs.  ARS 396.0 (2005) incorporates that new form.  .

Financial Sector (Collection of Data) Determination No. 104 of 2005

This revokes the reporting standards that are being replaced by those mentioned above.  However, this will be without prejudice to the obligation to lodge any overdue return under an old reporting standard. 

Consultation

The relevant Determinations replicate and consolidate existing reporting requirements under the reporting standards mentioned above.  Accordingly it is relevant to refer to the consultations made in relation to the old reporting standards.

Preparation and consultation for the original versions of these standards began in 1999. APRA, ABS and RBA were consulted extensively with the-banking, credit union and building society industries (both regional and in Sydney and Melbourne), via presentations and one-on-one meetings on the proposed changes to the ADI reporting requirements.

Positive reactions were received with significant support for the overall objectives of modernisation and rationalisation. Banks were particularly enthusiastic about the possibility of reducing the frequency of reporting in some cases and the dropping of outmoded content in others.

Consultation on the implementation of the original reporting standards also took place with individual ADIs, either through letters, phone discussions, emails, on-site visits or a mixture of some or all of these means. All major industry bodies including Australian Bankers Association and Credit Union Services Corporation (Australia) Limited were consulted.   All industry bodies consulted were supportive of the original standards when proposed.

Similarly, the Australian Securities and Investments Commission, the Australian Taxation Office, the Treasury, RBA and ABS were supportive of the original standards when proposed. The RBA and ABS agreed that APRA should be the central repository for the collection of financial sector data.

Initial consultations were undertaken between June and September 2003 in relation to the amendments effected by the Financial Sector (Collection of Data) Determination No. 5 of 2004 affecting capitalised expenses.  Whilst this consultation paper focused on the prudential requirements, industry was also made aware that the proposed amendments would have ramifications for their reporting obligations under the ADI reporting framework.

APRA undertook further consultation in mid 2005 to seek comments about the proposed revocation and redetermination of the reporting standards outlined above, including the amendments to the clause relating to the variation of reporting periods.  No substantial comments or objections were received about the proposals.
