Financial (Military) Regulations (Amendment)

STATUTORY RULES.

REGULATIONS UNDER THE DEFENCE ACT 1903-1956.*

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Defence Act 1903-1956.

Amendments of the Financial (Military) Regulations.†

Commencement.

1. These Regulations shall be deemed to have come into operation on the first day of July, 1960.

Parts.

2. Regulation 3 of the Financial (Military) Regulations is amended by omitting the words—

“Part II.—Pay and Pay Allowances (Regulations 6a-30).”

and inserting in their stead the words—

“Part II.—Pay and Pay Allowances—Permanent Military Forces (Regulations 6a-30).

Part IIa.—Pay and Allowances—Citizen Military Forces (Regulations 30a-30d).”.

Definitions.

3. Regulation 4 of the Financial (Military) Regulations is amended by omitting the definition of “member” and inserting in its stead the following definition:—

“‘member’ means a member of the Permanent Military Forces other than a member of the Corps of Staff Cadets, the Women’s Royal Australian Army Corps or the Royal Australian Army Nursing Corps;”.

Heading to Part II.

4. The heading to Part II. of the Financial (Military) Regulations is repealed and the following heading inserted in its stead:—

“Part II.—Pay and Pay Allowances—Permanent Military Forces.”.

Pay of General Officers.

5. Regulation 6a of the Financial (Military) Regulations is amended by adding at the end thereof the following sub-regulation:—

“(5.) This regulation does not apply to or in respect of an officer who is a member of the Citizen Military Forces.”.

6. After Part II. of the Financial (Military) Regulations the following Part is inserted:—

“Part IIa.—Pay and Allowances—Citizen Military Forces.

Definition.

“30a. In this Part, ‘member’ means a member of the Citizen Military Forces other than a member of the Women’s Royal Australian Army Corps or the Royal Australian Army Nursing Corps.

Pay relating to certain appointments.

“30b.—(1.) The rate of pay of a member performing duty in an appointment specified in the first column of the Third Schedule to these Regulations is the rate specified opposite to the appointment in the second column of that Schedule.

“(2.) The Chaplain-General who acts as secretary to the Conference of Chaplains-General shall be paid, in addition to the rate of pay specified in the Third Schedule to these Regulations, an allowance at the rate of Seven hundred and thirty-five pounds per annum.

Full-time duty with Permanent Military Forces.

“30c. The daily rate of pay of a member performing full-time duty in a Permanent Military Forces establishment is the daily rate of pay specified in these Regulations for a member of the Permanent Military Forces who, holds the same rank as the first-mentioned member or, where more than one rate of pay is so specified for such a member of the Permanent Military Forces, the lower of the lowest of those rates.

Rates of pay.

“30d.—(1.) Subject to this regulation, the rate of pay of a member, other than a member referred to in either of the last two preceding regulations, is the rate per day specified in relation to his rank or classification in whichever of the Fourth or Fifth Schedule to these Regulations is applicable.

“(2.) Where a member, other than a member referred to in the last preceding regulation—

(a) holds an appointment as a staff officer; or

(b) holds an appointment that is a part-time appointment in a Permanent Military Forces establishment,

and the member’s rank or classification is not the same as the rank or classification for the holder of such an appointment, the rate of pay of the member is—

(c) the rate per day specified in whichever of the Fourth or Fifth Schedule to these Regulations is applicable in relation to his rank or classification; or

(d) the rate per day specified in whichever of the Fourth or Fifth Schedule to these Regulations is applicable in relation to the rank or classification for the holder of such an appointment,

whichever rate is the less.

“(3.) The rate of pay of a medical officer or a dental officer who holds an honorary rank but does not hold a substantive rank is the rate per day specified in relation to the rank of captain in the Fourth Schedule to these Regulations, irrespective of his honorary rank.

“(4.) The rate of pay of a member in respect of an attendance at a parade designated as a half-day parade under the Australian Military Regulations is one-half of the rate for one day otherwise applicable under this regulation.

“(5.) The rate of pay of a member in respect of an attendance at a parade designated as a night parade under the Australian Military Regulations is one-third of the rate for one day otherwise applicable under this regulation.

Third, Fourth and Fifth Schedules.

7. The Financial (Military) Regulations are amended by adding at the end thereof the following Schedules:—

Daily Rates of Pay—Male Members of the Citizen Military Forces.
