Overview

The Statutory Rules 1961, No. 2, Regulations under the Defence Act 1903-1956, were enacted by the Governor-General in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council. This legislative instrument was introduced to address the need for specific regulations concerning the pay and conditions of native members of the Australian Military Forces serving in Papua and New Guinea. The policy objective of these regulations was to establish a clear and equitable system of remuneration for native members, taking into account their rank, length of service, and specific qualifications, while ensuring consistency with the existing Financial (Military) Regulations. These regulations, which came into operation on 1 July 1960, amend the Financial (Military) Regulations to include specific definitions and provisions for native members, setting out their pay rates based on their rank and length of service. Additionally, they clarify that certain existing regulations do not apply to native members, thus creating a tailored framework for their financial management within the military structure.

Scope and Application

These Regulations, made under the Defence Act 1903-1956, provide amendments to the Financial (Military) Regulations, specifically concerning the pay of "native members," defined as Aboriginal inhabitants of Papua or New Guinea serving in the Permanent Military Forces. The Regulations are effective from July 1, 1960, and establish a pay scale for native members based on rank and length of service, with specific rates outlined in the Sixth Schedule. Notably, native members may receive higher enlistment pay if they possess certain qualifications, but this cannot exceed Two pounds ten shillings per month. The Regulations also provide for allowances for native members who were receiving higher rates of pay before July 1, 1960, and include provisions for pay retention and increments, with certain conditions applicable. Some existing regulations do not apply to native members, as specified in the new regulation 7a. The Regulations do not explicitly mention any exclusions, exemptions, or thresholds, but the application is limited to native members serving in the Permanent Military Forces.

Key Provisions

The key provisions of these regulations concern the amendment of the Financial (Military) Regulations, specifically relating to the pay of native members, who are defined as Aboriginal inhabitants of the Territory of Papua or the Territory of New Guinea serving in the Permanent Military Forces. Regulation 7a introduces detailed provisions about the pay rates for native members, taking into account their rank and length of service. The regulations specify the monthly rates of pay based on service in rank and classification, with a Sixth Schedule detailing these rates. For example, a Warrant Officer Class I with less than one year’s service in rank is to be paid £2 9s 15d, whereas a Corporal with less than one year’s service in classification is to be paid £12 0s 0d. Additionally, the regulation allows for a higher enlistment pay for native members with specific qualifications, not exceeding £2 10s per month, and mandates that twenty-five percent of the pay shall be retained in a pay account until the completion of their engagement, re-engagement, or termination of service. The regulations impose specific obligations on the parties involved. The Military Board must determine the qualifications that allow a native member to receive a higher enlistment pay. The Minister must approve conditions for incremental advancement in the rate of pay. The Military Board must designate members holding specific classifications for the purposes of the regulation. Moreover, certain provisions of the Financial (Military) Regulations do not apply to native members. These obligations ensure that the financial provisions for native members are managed according to the specified conditions and classifications. Failure to comply with these regulations can result in various consequences. While the legislation does not explicitly state offences or penalties, non-compliance with the conditions set by the Military Board or the Minister could potentially lead to disputes over pay rates or allowances. Furthermore, not adhering to the designated classifications or conditions for pay increments might result in legal challenges or administrative actions. Although specific penalties are not detailed in the text, breaches of these provisions could be subject to relevant administrative or disciplinary measures under the Defence Act or other applicable laws.
