Overview
The Financial Management and Accountability (Amendment of Special Account) Determination 2001/04 was introduced to address the need for better financial management and accountability within the Commonwealth Service Delivery Agency. Enacted by John Joseph Fahey, the Minister for Finance and Administration under the Financial Management and Accountability Act 1997, this legislative instrument aimed to streamline the handling of unidentified or public monies held on trust by the Commonwealth Service Delivery Agency. The primary objective was to ensure these funds are appropriately managed and transferred to the relevant accounts once identified, thereby enhancing the transparency and efficiency of financial operations within the agency. This determination marked a significant reform by abolishing the ‘Other Trust Moneys Account’ established in 1997 and replacing it with a new account designed to better serve the financial needs of the Commonwealth Service Delivery Agency.
Scope and Application
The Financial Management and Accountability (Amendment of Special Account) Determination 2001/04, issued under the authority of the Financial Management and Accountability Act 1997, primarily impacts the Commonwealth Service Delivery Agency, particularly Centrelink, by abolishing the existing 'Other Trust Moneys Account' and establishing a new account titled 'Commonwealth Service Delivery Agency Other Trust Moneys Account (operated by Centrelink)'. The new account serves the specific purpose of handling the transfer of unidentified or other public monies held by the Commonwealth Service Delivery Agency to appropriate accounts once these monies have been identified, as well as managing the transfer and return of unidentified monies to the Official Public Account. This Determination applies nationally, affecting the financial management practices within the Commonwealth's service delivery framework. The scope of the Determination includes the transfer of unidentified or public monies held by the Commonwealth Service Delivery Agency and all payments made to the Commonwealth for the purposes specified in the new account. Any existing funds in the abolished account are automatically transferred to the newly established account upon the commencement of this Determination.
Key Provisions
The Financial Management and Accountability (Amendment of Special Account) Determination 2001/04, issued under the Financial Management and Accountability Act 1997, introduces significant changes to the financial management of trust monies held by the Commonwealth Service Delivery Agency (section 1). The Determination commences as specified in section 22 of the Act (section 2). One of the key changes is the abolition of the 'Other Trust Moneys Account', which was established by a previous determination on 31 December 1997 and was operated by Centrelink (section 3). This account previously held unidentified or other public monies, pending their identification or allocation to specific purposes.
In place of the abolished account, the Determination establishes a new account named 'Commonwealth Service Delivery Agency Other Trust Moneys Account (operated by Centrelink)' (section 4). The purpose of this new account is to facilitate the transfer of unidentified or other public monies held by the Commonwealth Service Delivery Agency to appropriate accounts once the moneys have been identified. Additionally, it allows for the transfer and return of unidentified monies to the Official Public Account. The account can receive funds that are either unidentified public monies temporarily held by the Commonwealth Service Delivery Agency or moneys paid to the Commonwealth by any person for the account's expenditure purpose (section 4(2)).
The Determination also mandates the transfer of any funds in the abolished account immediately before the commencement of this Determination to the newly established account (section 5). This transfer ensures a smooth transition and continuity in the management of trust monies. The obligations under this Determination require Centrelink to accurately identify and appropriately allocate any unidentified or public monies held on trust, ensuring compliance with the stated expenditure purposes of the new account.
Failure to comply with the provisions of this Determination may lead to administrative or legal consequences, although the specific penalties or consequences are not detailed within the text. The overarching requirement is for Centrelink to manage trust monies in accordance with the outlined purposes to maintain financial integrity and accountability.
