The legislative authority under which the instrument is made | Subsection 32(2) of the Financial Management and Accountability Act 1997 (FMA Act) enables the Minister for Finance and Deregulation (Finance Minister) to determine that one or more Schedules to one or more Appropriation Acts are amended in relation to the transfer of a function from one agency to another. Under section 62 of the FMA Act the Finance Minister has delegated this power to the Secretary of the Department of Finance and Deregulation (Finance). Under section 53 of the FMA Act, the Secretary of Finance has delegated this power to certain officials within Finance. | |
Purpose and effect of the instrument | Schedule 1 of 2011/02 amends Appropriation Act (No. 1) 2010-11 to transfer: (a) $18,800,149.31 of the departmental item for DSEWPC to the departmental item for DPMC; (b) $29,573,693.46 of DSEWPC’s administered item for outcome 5 to DPMC’s administered item for outcome 2. (c) $40,801,500 of the CAC Act body payment item for the Australia Council from DSEWPC to DPMC. (d) $9,897,219 of the CAC Act body payment item for the Australian Film, Television and Radio School from DSEWPC to DPMC. (e) $8,572,000 of the CAC Act body payment item for the Australian National Maritime Museum from DSEWPC to DPMC. (f) $12,332,500 of the CAC Act body payment item for the National Gallery of Australia from DSEWPC to DPMC. (g) $20,420,145 of the CAC Act body payment item for the National Library of Australia from DSEWPC to DPMC. (h) $11,151,108 of the CAC Act body payment item for the National Museum of Australia from DSEWPC to DPMC. (i) $10,261,250 of the CAC Act body payment item for the National Film and Sound Archive from DSEWPC to DPMC. (j) $2,411,000 of the CAC Act body payment item for Screen Australia from DSEWPC to DPMC. Schedule 2 of 2011/02 amends Appropriation Act (No. 2) 2010-2011 to transfer: (a) $682,500 of the CAC Act body payment item for the Australian National Maritime Museum from DSEWPC to DPMC. (b) $4,059,000 of the CAC Act body payment item for the National Library of Australia from DSEWPC to DPMC. (c) $296,666.69 of the CAC Act body payment item for the National Film and Sound Archive from DSEWPC to DPMC. Schedule 3 of 2011/02 amends Appropriation Act (No. 1) 2004-2005 to reduce DSEWPC’s administered item for outcome 4 by $8,217,220.76. Schedule 4 of 2011/02 amends Appropriation Act (No. 1) 2005-2006 to reduce DSEWPC’s administered item for outcome 4 by $621,966.52. Schedule 5 of 2011/02 amends Appropriation Act (No. 1) 2006-2007 to reduce DSEWPC’s administered item for outcome 4 by $1,894,900. Schedule 6 of 2011/02 amends Appropriation Act (No. 1) 2007-2008 to reduce DSEWPC’s administered item for outcome 4 by $3,443,358.57. Schedule 7 of 2011/02 amends Appropriation Act (No. 1) 2008-2009 to reduce DSEWPC’s administered item for outcome 4 by $1,113,767.31. Schedule 8 amends Appropriation Act (No. 1) 2009-2010 to increase DPMC’s administered item for outcome 2 by $15,291,213.16. The effect of this schedule is to transfer appropriations relating to the arts and culture function from DSEWPC to DPMC. | |
Background | The transfer of appropriation arises due to a Government decision to transfer responsibility for the arts and culture function from the Department of Sustainability, Environment, Water, Population and Communities to the Department of the Prime Minister and Cabinet. | |
