Overview

Enacted in 1931, the Financial Emergency Act 1931 was introduced by the Australian Parliament to address the financial crisis arising from the Great Depression and the associated impact on war pensions. The Act was designed to provide the government with the authority to take emergency measures to stabilise the financial situation and ensure the continued payment of pensions to war veterans. The Financial Emergency (War Pensions Inquiry Committee) Regulations 1931, made under the Act, established a War Pensions Inquiry Committee tasked with investigating the financial implications of war pensions and making recommendations to the Minister. The policy objective was to ensure the sustainability of pension payments while managing the financial strain on the government.

Scope and Application

The Financial Emergency (War Pensions Inquiry Committee) Regulations, made under the Financial Emergency Act 1931, establish a committee tasked with examining war pensions. This committee, referred to as the War Pensions Inquiry Committee, is composed of five members who must be members of an organization of returned soldiers and are appointed by the Minister. The committee is mandated to submit its recommendations to the Minister by a specified date, as outlined in section forty-one of the Act. These regulations are specifically designed to address the financial emergency arising from the war, focusing on the inquiry and recommendations related to war pensions. The regulations apply solely within the framework of the Financial Emergency Act 1931 and are limited in their duration, ceasing on the fifteenth of August, 1931. While the primary application is within the Commonwealth, the regulations' reach is determined by the overarching act, which may extend to national and jurisdictional levels as further defined by subordinate instruments.

Key Provisions

The main operative sections of the Financial Emergency (War Pensions Inquiry Committee) Regulations establish the formation and duties of a specific committee under the Financial Emergency Act 1931. According to section 2, the committee, referred to as the War Pensions Inquiry Committee, will consist of five members appointed by the Minister. Notably, section 2(3) stipulates that each member must be a member of an organization of returned soldiers. Furthermore, section 3 directs the committee to submit its recommendations to the Minister by a specified date, namely the fourteenth day of August, 1931, as per section 41 of the Financial Emergency Act 1931. The obligations and requirements imposed by these Regulations are primarily centred around the formation and function of the War Pensions Inquiry Committee. The Minister is tasked with appointing the committee members, ensuring that each member is a member of an organization of returned soldiers. Additionally, the committee has a clear timeframe within which to complete its inquiry and submit recommendations to the Minister, as mandated by section 3. These requirements ensure that the committee operates within a defined scope and adheres to a specific timeline for its activities. The Regulations also outline the consequences for non-compliance with the specified obligations. While the Regulations do not explicitly state offences or penalties for breaches, the requirement to submit recommendations by the stipulated date implies a formal and binding nature. Failure to adhere to the timeline could potentially lead to the invalidation of the committee's recommendations or other administrative consequences. However, the exact repercussions for non-compliance are not detailed within the text of the Regulations.
