Overview
The Statutory Rules 1908, No. 104, titled "Provisional Regulations under the Defence Acts 1903-1904," were enacted in 1908 to provide immediate operational measures under the Defence Acts, addressing the urgent need for financial and allowance regulations for the Naval Forces of the Commonwealth. This legislative instrument was issued by the Governor-General in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, recognising the immediacy of the matter. The regulations amend existing provisions to allow for flexibility in the provision of rations and special duty pay and allowances for naval personnel, while also introducing allowances for officers, warrant officers, and others attending courses of instruction in other states. The overarching objective is to ensure that the naval forces are adequately supported and managed in a manner that reflects the specific needs and conditions of their duties.
Scope and Application
The Provisional Regulations under the Defence Acts 1903-1904, established by Statutory Rules 1908 No. 104, pertain specifically to the financial and allowance regulations for the Naval Forces of the Commonwealth. These regulations apply to personnel within the naval forces, including officers, warrant officers, and other ranks, who are employed and qualified as instructors. They also extend to those attending courses of instruction in other states, thereby covering a broad range of military personnel across various roles and locations. The regulations are designed to provide allowances for rations, quarters, and special duty pay, ensuring that these individuals receive adequate support tailored to their duties and locations. The application of these provisions is immediate, as certified by the Governor-General, and they operate within the jurisdictional scope of the Commonwealth, addressing the urgent needs of the naval forces at the time of enactment. While the regulations provide for flexibility in rations to suit local conditions, they also establish clear allowances for those attending courses outside their home states, ensuring consistency and fairness in compensation.
Key Provisions
The Statutory Rules of 1908, No. 104, detail provisional regulations under the Defence Acts 1903-1904, specifically focusing on financial and allowance regulations for the Naval Forces of the Commonwealth. Regulation 49a allows Commandants the discretion to vary the scale of rations to suit local conditions, provided the contract price is not exceeded (Regulation 49a). This amendment enables a more flexible approach to the distribution of rations, accommodating regional differences in food availability and cost.
Further amendments are made to Regulation 50, which now specifies that special duty pay for instructors is additional to the allowance for Seaman Gunner and Torpedoman (Regulation 50). This change clarifies that instructors receive supplementary pay on top of their base allowance. Additionally, Regulation 78a introduces provisions for officers, warrant officers, and other personnel attending courses of instruction in other states, stipulating that they will be provided with quarters and rations, with specific allowances paid in lieu of travel allowances (Regulation 78a).
The regulations impose obligations on the Naval Forces, requiring Commandants to adhere to the stipulated scales and allowances when distributing rations and special duty pay. They also mandate that officers and warrant officers attending courses outside their home states receive designated allowances, ensuring consistency and fairness in compensation. Failure to comply with these provisions could result in administrative discrepancies and potential grievances among personnel.
In terms of penalties, the legislation does not explicitly state penalties for non-compliance. However, breaches of the allowances and rations regulations could lead to disciplinary actions or financial discrepancies, potentially impacting the operational efficiency and morale of the Naval Forces. These breaches might also have civil or administrative consequences, although specific penalties are not detailed within the text.
