Overview

The Statutory Rules 1911, No. 123, issued under the Naval Defence Act 1910, addresses an urgent need to regulate the financial and allowance structure for the naval forces of the Commonwealth. Enacted by the Governor-General in Council, this Provisional Regulation was certified to come into immediate effect on the 1st of July 1911, underscoring the urgency of the matter. The policy objective is to amend the financial regulations concerning the pay and allowances for various ranks within the naval forces, ensuring that petty officers, men, and boys, including signal boys and engine-room artificers, receive appropriate remuneration based on their ratings and seniority in rank. This regulation specifically modifies the financial allowances for Petty Officers and Men, addressing the active and deferred pay as well as additional emoluments, reflecting the structured hierarchy and roles within the naval forces.

Scope and Application

The Provisional Regulation under the Naval Defence Act 1910 pertains specifically to the financial and allowance regulations for the naval forces of the Commonwealth, coming into immediate operation as of the 1st day of July, 1911. It encompasses the pay of permanent forces, particularly addressing amendments to the financial regulation for Petty Officers, Men, and Boys. This regulation details modifications in pay and allowances based on rank, seniority, and specific roles within the naval forces. The regulations apply to all personnel within the Commonwealth naval forces, establishing a structured framework for their financial remuneration. While the regulation addresses specific financial aspects, it does not explicitly outline exclusions or thresholds, indicating a comprehensive application to the enlisted personnel as defined. The Provisional Regulation may be further extended or modified through subordinate instruments to accommodate evolving needs within the naval forces.

Key Provisions

The main operative sections of this Provisional Regulation (C1911L00123) under the Naval Defence Act 1910, particularly in Part II, deal with the amendments to Financial Regulation 49(I) concerning the pay of permanent forces. These sections introduce specific changes to the pay and allowances for Petty Officers, Men, and Boys within the Naval Forces. For example, it modifies the rating and seniority in rank, and includes new categories such as "Boy Apprentice" and "Engine-room Artificer 5th Class" (sections not numbered explicitly but inferred from the text). These changes dictate the financial structure for these ranks and roles, including the addition and subtraction of certain categories and their respective pay scales. The obligations and requirements imposed by these provisions on the parties involved, such as Petty Officers, Men, and Boys, include adherence to the new pay scales and allowances as outlined. The regulation specifies the financial entitlements based on rank, years of service, and specific roles within the Naval Forces. For instance, it details the "Active Pay" and "Deferred Pay" and provides additional emoluments, which are to be strictly followed. This includes ensuring that the correct pay rates are disbursed according to the new amendments, and that the classifications of roles and seniority are accurately reflected in the financial records and disbursements. Any breaches of these financial regulations could result in serious consequences. Although the exact penalties are not detailed in the provided text, under Australian law, non-compliance with financial regulations can lead to both civil and criminal penalties. Civil penalties might include fines or other monetary sanctions, while criminal penalties could involve imprisonment, depending on the severity and intent of the breach. Given the nature of the regulation and its impact on the financial stability of personnel, adherence to these provisions is crucial to avoid legal repercussions.
