PROVISIONAL REGULATIONS UNDER THE NAVAL DEFENCE ACT 1910.

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby certify that, on account of urgency, the following Regulations under the Naval Defence Act 1910 should come into operation on and from the 1st July, 1911, and make the Regulations to come into operation accordingly as Provisional Regulations.

Addition.

PART II.—PAY OF PERMANENT FORCES.

Cancel Regulations 48 to 50a inclusive, and substitute the following:—

Pay and Allowances for Officers (Sea-going).

48. (I.). The following rates of “active pay” “deferred pay” and allowances shall apply to Officers appointed for sea-going service to the Commonwealth Permanent Naval Forces on or after 1st July, 1911. Officers now serving in the Commonwealth Permanent Naval Forces (except those employed in the Central Administration or in shore appointments) may continue to draw the rates of pay under Regulations existing at 30th June, 1911, or may, if they prefer, accept the new rates of pay prescribed under this Regulation from 1st July, 1911.

Officers who accept the new rates of pay prescribed in this Regulation shall be compulsorily retired at the ages set forth below:—

The following rates of “active pay” “deferred pay” and allowances shall apply to Petty Officers, men, and boys appointed to the Commonwealth Permanent Naval Forces for sea-going service on or after 1st July, 1911. Petty Officers and men now serving in the Commonwealth Permanent Naval Forces may continue to draw the rates of pay under Regulations existing at 30th June, 1911, or may, if they prefer, accept the new rates of pay prescribed under this Regulation from 1st July, 1911.

Petty officers and men who accept the new rates of pay prescribed in this Regulation shall be compulsorily retired at the ages set forth below:—

49. (II.). Allowances for uniform, rations, and medical attendance.

In addition to “active pay” and “deferred pay,” each Petty Officer and man shall receive:—

49. (III). Good Conduct Badges and Good Conduct Medals will be awarded as follows for all ratings up to and including Chief Petty Officers, but Good Conduct Badges should not be worn by Chief Petty Officers:—

Deferred Pay.

50. The “deferred pay” mentioned in the foregoing tables will be dealt with on the following system:—

(a) A definite amount per diem to be deferred for each officer or man, but to be considered as a portion of his emoluments.

(b) The account of each officer or man to be credited with the amount so deferred, and with interest thereon; the interest

(i) to be allowed at the rate of 3½ per cent.;

(ii) to be added to each individual’s account annually;

(iii) to be computed annually on the amount standing to the credit of the individual at the end of the previous financial year.

(c) On retirement or resignation in the case of an officer, or on discharge in the case of a man, the actuarial equivalent of the accumulated amount of his contributions to be granted to him; the individual concerned to have the option of receiving this actuarial equivalent—

(i) in the form of an annuity for life; or

(ii) half in the form of an annuity, and half in the form of a cash payment; or

(iii) in other form, if desired, in special circumstances, to be decided by the Naval Board.

Persons dismissed from the Navy for misconduct to forfeit all claim to deferred pay.

(d) In the case of death of an individual whilst in the service, the full amount of accumulated deferred pay, with interest to date of death, to be payable to his estate.
