Overview

The Statutory Rules of 1912, No. 239, titled "Provisional Regulations Under the Naval Defence Act 1910-11," was enacted to provide immediate financial and allowance regulations for the naval forces of the Commonwealth of Australia. This legislation was introduced to address the urgent need for structured financial provisions within the navy, ensuring that personnel were appropriately compensated for their service. The regulations were certified by the Governor-General, acting on the advice of the Federal Executive Council, and they came into immediate operation on 1 October 1912. The policy objective behind these provisional regulations was to establish a clear framework for allowances related to uniform, rations, medical attendance, and other necessary expenses for naval personnel, as well as to ensure proper accounting for these payments.

Scope and Application

The Provisional Regulations Under the Naval Defence Act 1910-11, which came into immediate effect on 1st October 1912, pertain to the financial and allowance regulations for the naval forces of the Commonwealth. These regulations apply to all personnel within the naval forces, including "each man and boy" serving in the Permanent Naval Forces. They cover allowances for uniform, rations, medical attendance, and other benefits such as a clothing gratuity for those who join the service. The regulations also extend to the payment of deferred pay under specific conditions and the provision of allowances for the care of mess traps and for Naval Reserve Chaplains who provide religious ministrations to seamen. The scope of the Act is national, given its foundation under the Commonwealth's Naval Defence Act, and the provisions are enforced through the Naval Board as specified. There are no stated exclusions or thresholds within the excerpted text, but allowances and benefits are subject to conditions that may be prescribed by the Naval Board.

Key Provisions

The Provisional Regulations under the Naval Defence Act 1910-11, specifically Statutory Rules 1912 No. 239, detail amendments to financial and allowance regulations for the Naval Forces of the Commonwealth. Regulation 43 (II) now specifies that, in addition to active and deferred pay, each man and boy shall receive certain allowances, such as a uniform allowance of £9 2s. 6d. per annum, rations in kind or an allowance at a rate of 1s. 2d. per diem, and medical attendance valued at 3d. per diem, totalling £3 4s. 1¾d. per annum (section 43 (II)). Regulation 43 (III) outlines the clothing gratuity and allowance towards the cost of uniform, stating that each man and boy shall be credited with a clothing gratuity of £9 2s. 6d. upon joining and an allowance of 6d. per day in kind after completing twelve months of service (section 43 (III)). The Regulations impose several obligations on the parties involved. Firstly, they mandate that clothing gratuity or allowance towards the cost of uniform shall not be paid directly to the individual but rather used for the uniform clothing issued, with the cost charged against the gratuity or allowance (section 43 (III)). Additionally, the kit to be maintained by each man or boy must adhere to the Uniform Regulations, with any additional clothing required being at the individual's expense (section 43 (III)). Furthermore, in the event of a rating being discharged within one year of first entry, the value of clothing issued in excess of the allowable amount shall be deducted from the deferred pay due, with any balance remaining as a charge against the gratuity (section 43 (III)). The Regulations also delineate specific offences and penalties for non-compliance. For instance, any breaches of the financial and allowance regulations could lead to administrative or disciplinary actions as prescribed by the Naval Board. The Regulations further clarify that deferred pay for each completed term of engagement or re-engagement shall not be subject to forfeiture in the case of men (section 44 (d)). However, men entered or re-engaged on and after 1st January 1913 shall not be entitled to draw deferred pay until the expiration of the period for which they engaged or re-engaged, except for engagements commenced prior to 1st January 1913, which would be payable upon termination or discharge (section 44 (f)). Failure to adhere to these provisions could result in financial discrepancies or administrative penalties, as determined by the Naval Board.
