Overview

The Statutory Rules 1913 No. 44, titled "Provisional Regulations under the Naval Defence Act 1910-11," was enacted to address the need for immediate implementation of financial and allowance regulations for the Naval Forces of the Commonwealth. These Provisional Regulations were made under the authority of the Governor-General in Council and came into operation on specified dates to ensure prompt effect. The policy objective was to establish a structured framework for the remuneration and allowances of naval officers and personnel, ensuring consistency and fairness in pay and benefits. The regulations amended existing provisions to adjust allowances and pay rates, reflecting changes such as seniority in rank and service duration. This legislative instrument was intended to provide clarity and predictability in the compensation structure for the naval forces, addressing both officers and enlisted personnel.

Scope and Application

The Provisional Regulations under the Naval Defence Act 1910-11 primarily apply to the financial and allowance regulations for the naval forces of the Commonwealth, specifically focusing on the personnel within the naval service. These regulations encompass various ranks, from warrant officers and commissioned warrant officers to petty officers, men, and boys, as well as administrative and instructional staff. The provisions outlined in these regulations dictate the rates of pay and allowances for these personnel, with adjustments and additions effective from specific dates such as 1st January 1913 and 1st October 1912. These regulations also address special allowances for married sea-going warrant officers and petty officers, and establish guidelines for increments and deductions in pay. The scope of these regulations is limited to the Commonwealth and does not extend to state or territory levels. Any exclusions or exemptions are not explicitly detailed within the text, though allowances and pay rates are contingent on specific conditions and the approval of the Naval Board. The application of these regulations is further managed through subordinate instruments that can extend or restrict their provisions.

Key Provisions

The key operative sections of the Provisional Regulations under the Naval Defence Act 1910-11 include amendments to financial and allowance regulations for naval forces. These regulations primarily focus on adjusting rates of pay and allowances for various ranks and categories within the naval forces. For instance, Regulation 42 (iii) modifies the allowance for Senior Lieutenants to include establishments in addition to ships (Section 42 (iii)). Similarly, Regulation 42 (iv) updates the pay rates for Warrant Officers and Commissioned Warrant Officers based on seniority and other factors (Section 42 (iv)). Additionally, Regulation 43 (i) introduces new pay rates for Petty Officers, Men, and Boys as of 1 October 1912 (Section 43 (i)). These regulations aim to ensure that naval personnel receive appropriate compensation aligned with their duties and ranks. The Act imposes several obligations and requirements on the parties governed by it. Firstly, it mandates the adjustment of pay rates and allowances for various ranks and categories within the naval forces, ensuring that all personnel receive fair compensation. For example, Regulation 42 (vi) introduces a new allowance for married sea-going Warrant Officers and Chief Petty Officers attached to Harbor Training Establishments or Harbor Training Ships (Section 42 (vi)). Secondly, it specifies conditions under which certain allowances are payable, such as the allowance in lieu of married quarters, which must be prescribed by the Naval Board (Section 42 (vi)). Thirdly, it outlines the process for increments in pay, detailing who is eligible for such increments and under what conditions they are granted (Sections 42, 43). These obligations are crucial for maintaining equitable pay structures within the naval forces. The Provisional Regulations also outline offences, penalties, and consequences for non-compliance. While the regulations themselves do not explicitly state penalties for breaches, it is implied that failure to adhere to the prescribed pay rates and allowances could result in legal and administrative repercussions. For example, if an officer or petty officer receives less than the minimum rate prescribed for their rank or rating, they are entitled to receive the minimum rate retroactively from 1 July 1912 (Section 50 (a)). Additionally, any misuse of allowances, such as claiming allowances without meeting the specified conditions, could lead to disciplinary actions or financial penalties as determined by the Naval Board and the Minister. These measures ensure compliance and maintain the integrity of the naval forces' pay and allowance systems.
