6d. an hour. This payment is to be made to the actual Attendant on each Diver and not to the Warrant Officer in charge of the party.

(a) The period for which payment is made is to count from the time of entering to that of leaving the water; and should the work be subsequently found to be improperly done, the Captain, at his discretion, may cancel the whole or any portion of the payment.

(b) Artificer Divers, when actually employed under water on a purely mechanical piece of work which the ordinary Diver is not capable of efficiently performing, and when not paid a bonus or gratuity, are to be paid half a day’s pay of their substantive rating for every hour and proportionately for parts of an hour, in addition to the Diving Pay to which they may be entitled for the several depths.

(c) For recovery of articles, a bonus not exceeding £1 nor one-fourth the value of the article, may be given in lieu of payment by scale, of which bonus one-tenth is to be paid to the Attendant.

When diving takes place for recovery of articles, a certificate should be inserted on the Extra Pay sub-voucher, stating whether blame was attributable to any Officer or man for the loss; and, if so, where the corresponding charge has been made against their pay.

(d) A gratuity, not exceeding £5, may be given in lieu of payment by scale, in exceptional circumstance requiring despatch, and for important skilled work satisfactorily performed, of which gratuity one-eighth is to be paid to the Attendant.

(e) A Diver who falls to conform to the conditions of exercise, or is at any time unwilling to dive, is liable to be deprived of his Diver rating and retaining pay for the current quarter.

(f) Only one first hour rate is to be paid for any one day but in cases of diving at two different depths payment may be made at whichever first hour rate is more advantageous to the Diver.

(g) Details of amounts paid for Diving Pay are to be shown on Form A.S. 9, which should accompany the ledger into office.

_______________

Printed and Published for the Government of the Commonwealth of Australia by Albert J. Mullett, Government Printer for the State of Victoria.

Overview

The Statutory Rules of 1913, No. 169, titled "Provisional Regulations Under the Naval Defence Act 1910-1912: Financial and Allowance Regulations (Provisional) for the Naval Forces of the Commonwealth," were introduced to address the urgent need for financial and allowance regulations for the naval forces of the Commonwealth. Enacted by the Governor-General on behalf of the Commonwealth of Australia, these provisional regulations were necessitated by the immediate operational requirements of the naval forces. The policy objective of these regulations was to establish clear guidelines for the financial and allowance structure within the naval forces, ensuring that the personnel received appropriate compensation for their service and duties. These regulations, effective from specified dates, provided for allowances such as submarine pay, special allowances for warrant officers, physical training allowances, and diving pay, among others, thereby addressing the financial needs of naval personnel in a structured manner.

Scope and Application

The Financial and Allowance Regulations (Provisional) for the Naval Forces of the Commonwealth, enacted under the Naval Defence Act 1910-1912, govern financial matters and allowances for personnel serving in the Australian naval forces. These regulations apply to various ranks and roles within the naval forces, including officers, warrant officers, petty officers, men, and boys, and cover a range of allowances such as submarine pay, diving pay, harmonium allowance, and married quarters. The regulations are provisional, effective from specific dates mentioned in the document, and they establish detailed pay scales, including active pay, deferred pay, and additional emoluments for different ratings and seniority levels. The scope of these regulations is limited to the Commonwealth of Australia, and they are administered and enforced by the Naval Board, which has the authority to make further regulations and prescribe conditions for the allowances. The regulations do not explicitly mention exclusions or thresholds, but they are intended to provide immediate financial provisions for the naval forces, reflecting the urgency noted by the Governor-General and the Federal Executive Council.

Key Provisions

The main operative sections of these Provisional Regulations under the Naval Defence Act 1910-1912 pertain to financial allowances and adjustments for various ranks within the Naval Forces of the Commonwealth. Regulation 42 modifies allowances for both Subordinate and Commissioned Officers, as well as Warrant Officers. It introduces new rates for submarine pay for different officer ranks and adjusts the allowance for Warrant Officers who live on board certain vessels or are attached to a Naval Establishment (Reg. 42 (III), (VI)). Regulation 43 outlines new rates of pay for Petty Officers, Men, and Boys, including new classifications and adjustments for various ratings such as Shipwright, Carpenter’s Mate, and others (Reg. 43 (I), (J)). Moreover, it establishes new diving pay rates based on depth and duration of the dive, as well as introduces a Harmonium Allowance and modifies the Schoolmaster allowance (Reg. 43 (V)). The Regulations impose specific obligations and requirements on the parties and entities they govern. These include the requirement for Warrant Officers to join the mess including all Officers to qualify for their allowance, and the need for officers to pass examinations and meet service criteria to advance to higher ratings. Petty Officers, Men, and Boys must adhere to the new rates of pay specified for their respective classifications and seniority levels. Additionally, Diving Pay and related allowances must be calculated and paid according to the detailed conditions and rates set forth in the Regulations. Officers and enlisted personnel must also comply with the conditions governing the payment of allowances such as the Harmonium Allowance, Schoolmaster allowance, and Married Allowance. Breach of these Regulations could result in various civil or administrative consequences. For instance, failure to meet the conditions for allowances or advancements could result in denial of such benefits. Non-compliance with the prescribed pay rates might lead to disputes regarding remuneration. Additionally, the Regulations explicitly state that divers who do not conform to exercise conditions or are unwilling to dive may be deprived of their Diver rating and retaining pay for the current quarter. While the Regulations themselves do not explicitly outline criminal penalties, non-compliance with broader naval regulations or misconduct in the performance of duties could potentially lead to disciplinary action under other applicable military laws.
