Where no provision exists for members of the Forces carrying out the training afloat, the 21 days’ drill will be performed in such whole day, half day, and night drills or parades as may be authorized by the Minister.

Pay will be issued to Commanding Officers and Staff on the certificate of the Commandant that they have performed the necessary duties during the period for which it is claimed.

Overview

The "Financial and Allowance Regulations for the Naval Forces of the Commonwealth, 1904 (Provisional)" was enacted by the Commonwealth of Australia to establish the financial regulations and allowances for members of the Naval Militia. This legislative instrument was introduced to ensure that the Naval Militia members were compensated appropriately for their service, including their training, drills, and retainers. The enactment aimed to formalise the financial aspects of service within the newly established Naval Forces, ensuring consistency and fairness in the remuneration of members. The policy objective was to provide a structured and transparent system for the payment of allowances, which would support the operational readiness and morale of the Naval Militia. The regulations were brought into operation on 1st July, 1904, and were overseen by the Department of Defence, reflecting the government's commitment to building a professional and well-supported naval force.

Scope and Application

The Financial and Allowance Regulations for the Naval Forces of the Commonwealth, 1904, governs the payment of members of the Naval Militia, establishing specific rates of pay and annual retainers based on rank or rating. The regulations apply to members of the Naval Militia, who are required to undertake a specified number of training days and drills, either in continuous training afloat or in specified combinations of day, half-day, and night drills. The regulations also apply to commanding officers and staff, who must perform their duties to receive pay, and to members required to attend a review or general inspection on a public holiday. The provisions extend to the payment of retainers, the minimum duration of drills, and the provision of rations to members during continuous training or afloat for a whole day’s drill. The regulations apply nationally, covering the whole Commonwealth of Australia, and are subject to adjustments and approvals by the Minister as per the provisions on the Estimates. The Act does not specify any exclusions or exemptions, and the application is extended or restricted through subordinate instruments as necessary.

Key Provisions

The statutory rules establish detailed provisions for the payment and allowances of members of the Naval Militia, setting out specific rates of pay and annual retainers (sections 72-79). These provisions are subject to parliamentary approval and delineate the financial entitlements for different ranks and ratings within the Naval Militia based on the number of days of training and the type of drills performed. For instance, lieutenants and engineers receive different pay rates compared to warrant officers and petty officers, with varying allowances for retainers and total pay. The training requirements are also clearly defined, with two classes of training outlined: Class A, which requires 18 days of continuous training afloat out of 21 days, and Class B, which combines continuous training with specific numbers of half-day and night drills. Members who perform training under Class B receive quarterly payments for their drills, with minimum drills required for each quarter to earn pay. The legislation imposes specific obligations on the members of the Naval Militia. Members must complete the prescribed number of training days and drills to earn their pay and retainers. This includes the requirement to attend one Review or General Inspection on a public holiday, with failure to comply leading to a fine of twenty shillings unless excused by the Commandant (section 75). The members must also meet the minimum duration for whole day, half day, and night drills, which are set at eight hours, three hours, and one and a half hours respectively (section 78). Additionally, the legislation requires that the pay and retainers for members of the Naval Militia be issued upon certification by the Commandant that the members have performed the necessary duties (section 72). Breaches of the statutory rules carry specific penalties and consequences. Members who fail to comply with the requirement to attend a Review or General Inspection on a public holiday are liable to a fine of twenty shillings unless they can prove that they were prevented by sickness, other reasonable cause, or their occupation from attending (section 75). The rules also include provisions for the payment of retainers and pay in the event of the death of a member, ensuring that any due balance is paid to their legal representative (section 77). These provisions are designed to enforce compliance and ensure that members fulfill their obligations while also providing a safety net for their families in case of unforeseen circumstances.
