Overview
The Statutory Rules 1915, No. 90, titled "Provisional Regulations Under the Defence Act 1903-1915," was enacted to address the immediate need for financial and allowance regulations for the military forces of the Commonwealth. This legislative instrument was issued by the Governor-General in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, and was brought into immediate operation to ensure that these regulations were effective from the first day of July 1914. The policy objective behind these provisional regulations was to provide clear financial guidelines for military personnel holding special appointments, ensuring that they received appropriate compensation in addition to their regular pay. The regulations were intended to have the same force as if they had been enacted by the Parliament, highlighting the urgency and necessity of these financial provisions for the military during this period.
Scope and Application
The Provisional Regulations under the Defence Act 1903-1915, as specified in Statutory Rules 1915, No. 90, apply to officers within the Military Forces of the Commonwealth who hold specific appointments. These regulations pertain to the financial remuneration, particularly the special duty pay, for officers who occupy special roles within the military hierarchy. The specified officers include Members of the Military Board, Commandants of various military districts, and various other designated roles such as the Representative in England and Chief Instructors. The special duty pay is intended as a supplement to their regular regimental pay. Notably, if an officer holds more than one of these special appointments, they are only entitled to receive the special duty pay for one of the appointments. The regulations have a national reach, applying across the Commonwealth of Australia. There are no stated exclusions or exemptions within the text of the regulation itself, although further details on application and interpretation might be found in subordinate instruments. The amendment made to Regulation 99, effective from July 1, 1914, reflects adjustments in the rates of special duty pay for certain positions.
Key Provisions
The Financial and Allowance Regulations for the Military Forces of the Commonwealth, specifically Regulation 99, delineate the special duty pay rates for officers holding particular appointments in addition to their regular regimental pay. This regulation (Reg. 99) lists the special duty pay for various appointments, such as Members of the Military Board (£75 per annum) and Commandants of different military districts (ranging from £50 to £175 per annum). Notably, an officer holding more than one of these special appointments is only permitted to receive the special duty pay for one of those appointments. This regulation provides clarity on the financial compensation for officers who undertake specific roles within the military hierarchy.
The obligations imposed by Regulation 99 primarily concern the payment of special duty pay to officers in specified roles. The regulation requires the Defence Force to ensure that eligible officers receive the correct amount of special duty pay in accordance with their appointments. This includes calculating and disbursing the appropriate pay rates as outlined, ensuring that officers do not receive payment for more than one special appointment if they hold multiple roles.
Breaching the provisions of Regulation 99 could result in administrative consequences for both the Defence Force and the officers involved. While the specific offences and penalties are not detailed in the regulation itself, it is likely that failure to comply with the pay rates or improper payment of special duty allowances could lead to financial discrepancies, disciplinary actions, or other administrative penalties. The Defence Force is responsible for ensuring adherence to these financial regulations to maintain transparency and fairness in the payment of allowances.
