Overview

The Provisional Regulations under the Defence Act 1903-1911, enacted in 1912, were introduced to address the urgent need for financial and allowance regulations for the military forces of the Commonwealth. This was necessitated by the rapid expansion and the increasing complexity of the Australian military's operational requirements. The Governor-General, acting on the advice of the Federal Executive Council, certified the immediate implementation of these regulations due to their pressing nature. The key policy objective was to ensure that military officers, including those temporarily appointed as General Staff Officers, received adequate financial compensation to support their roles effectively. These Provisional Regulations were intended to be in effect from the first day of July, 1911, underscoring the urgency of the financial and administrative measures required for the military forces.

Scope and Application

The Provisional Regulations under the Defence Act 1903-1911, specifically the Financial and Allowance Regulations (Provisional) for the Military Forces of the Commonwealth, pertain to the regulation of financial and allowance matters for personnel within the Australian military forces. These regulations apply to officers appointed temporarily as General Staff Officers, who are entitled to an additional annual payment of £25 on top of their ordinary regimental pay according to their rank. The regulations, which were enacted with urgency and are thus considered provisional, apply to the Commonwealth of Australia and are intended to provide immediate financial support to military officers in specific roles within the defence framework. The regulations do not explicitly mention any exclusions, exemptions, or thresholds, but it is implicit that they apply only to those officers who meet the specified criteria of being temporarily appointed as General Staff Officers. These provisional regulations are set to be in effect as of July 1, 1911, and are subject to future amendment through subordinate instruments to refine or extend their application as necessary.

Key Provisions

The main operative section of this statutory rule, specifically Regulation 84 (f), mandates that officers appointed temporarily as General Staff Officers are to be granted an additional payment of £25 per annum, on top of their regular regimental pay according to their rank (Regulation 84 (f)). This provision ensures that these officers receive a supplementary remuneration for their specific duties as General Staff Officers, thereby recognising the additional responsibilities and expertise required for this role. The Act imposes specific financial obligations on the Commonwealth, ensuring that General Staff Officers receive the additional payment as stipulated. This means that the Commonwealth must budget for and disburse the £25 per annum supplement to the eligible officers, in addition to their regular regimental pay. This obligation is clear and direct, ensuring that there is no ambiguity regarding the compensation for these officers. For any breach of the requirements set forth in the statutory rule, the Act does not explicitly state any offences, penalties, or civil/criminal consequences. However, failure to comply with financial obligations under statutory regulations can generally lead to legal ramifications, including potential enforcement actions by the relevant authorities. The precise penalties would depend on the specific context and the legal framework governing such breaches, though they may include fines or other corrective measures.
