Overview

The Statutory Rules 1914 No. 39, titled "Provisional Regulations Under the Defence Act 1903-1912: Financial and Allowance Regulations for the Military Forces of the Commonwealth – Regulations 72a and 74 – Amendment," was enacted in 1914. The urgency of the matter is underscored by the immediate operation of these regulations, which were made effective from 1 January 1914. These provisional regulations were introduced to address the need for prompt amendments to the financial and allowance regulations governing the military forces. The regulations were made under the authority of the Governor-General in accordance with the Defence Act 1903-1912. The stated policy objective of these regulations was to ensure that the financial and allowance structures for various military roles and special duties were adequately defined and promptly updated to reflect any changes in the military hierarchy or operational needs.

Scope and Application

The Financial and Allowance Regulations for the Military Forces of the Commonwealth, as amended by Statutory Rules 1914 No. 39, applies to the members of the military forces of the Commonwealth of Australia. These regulations govern the financial and allowance aspects of military personnel, including rates of pay and extra pay for specialists and special duties. The application of these regulations extends across the Commonwealth, binding all members of the military forces, irrespective of their location within Australia. These provisional regulations were deemed to have come into operation on the first day of January, 1914, and were enacted under the Defence Act 1903-12, thereby providing a legal framework for the remuneration of military personnel. The regulations do not explicitly mention exclusions or exemptions, suggesting that they apply broadly to all eligible members of the military forces unless otherwise specified by higher authority or subsequent legislation. The ability to extend or restrict application through subordinate instruments is not directly addressed in the text, but given the provisional nature of the regulations, it is likely that amendments or further clarifications could be introduced through additional statutory instruments or legislative amendments.

Key Provisions

The main operative sections of the Financial and Allowance Regulations for the Military Forces of the Commonwealth, as amended by Statutory Rules 1914 No. 39, pertain to adjustments in rates of pay for certain ranks and appointments within the military (Regulation 72(c)) and modifications to the rates of extra pay for Specialists and special duties (Regulation 74). Specifically, Regulation 72(c) introduces a new rank, Staff Sergeant (Master Tailor), with a consolidated annual pay rate of £183. Regulation 74 outlines revised rates for various specialist roles and duties, replacing the previous provisions with updated rates of extra pay. The obligations and requirements imposed by these regulations involve ensuring that all financial compensations are correctly administered in accordance with the stipulated rates. The regulations mandate that these pay adjustments and extra pay rates are to be strictly followed, ensuring that personnel receive their entitlements as per the established schedules. For instance, the inclusion of the new rank of Staff Sergeant (Master Tailor) necessitates that this role is compensated at the specified annual rate, while the changes in specialists’ and special duty pay rates require that affected personnel are compensated at the new rates, as detailed in the amended Regulation 74. Breaches of these regulations could potentially result in financial discrepancies, with implications for both the military personnel and the Commonwealth. While the specific legal consequences for non-compliance are not explicitly stated in the legislative instrument, general breaches of military regulations could lead to administrative penalties, disciplinary actions, or other legal repercussions. The seriousness of such breaches would depend on the specific context and the extent of non-compliance.
