Overview
The Statutory Rules 1911 No. 37, titled "Provisional Regulations Under the Defence Act 1903-1910," was enacted by the Governor-General in Council on 3 March 1911 to address the immediate need for financial and allowance regulations for military forces. The enactment was driven by the urgency to establish provisional regulations concerning the military forces, reflecting the necessity to ensure that the Commonwealth's military operations were supported with adequate financial provisions. The policy objective of these provisional regulations was to provide the military forces with necessary allowances, including pay and allowances for personnel at the Special School of Instruction designated for training instructional staff of non-commissioned officers. This legislation was issued under the Defence Act 1903-1910 and was intended to take effect from 1 March 1911.
Scope and Application
The Provisional Regulations under the Defence Act 1903-1910, as detailed in Statutory Rules 1911, No. 37, establish provisional rules for financial and allowance regulations specifically for the military forces of the Commonwealth. These regulations apply to individuals appointed to the Special School of Instruction designated for the training of an instructional staff of non-commissioned officers. The provisions ensure that these personnel are granted pay at the minimum rate prescribed for non-commissioned officers of the instructional staff, along with the entitlement to a uniform and rations or an approved allowance in lieu. This legislative instrument has a specific jurisdictional reach, applying to the Commonwealth of Australia and impacting military personnel engaged in training capacities as defined under the Defence Act 1903-1910. The regulations, enacted with urgency and coming into effect on the first day of March 1911, are designated as provisional, indicating they are subject to future adjustment or formalisation through additional legislative processes.
Key Provisions
The main operative sections of this Provisional Regulation (Regulation 85(a)) under the Defence Act 1903-1910 pertain to the remuneration and allowances for personnel appointed to the Special School of Instruction. Specifically, Regulation 85(a) states that individuals assigned to the Special School of Instruction for the purpose of training an Instructional Staff of Non-Commissioned Officers will receive pay at the minimum rate prescribed for Non-Commissioned Officers of the Instructional Staff, as outlined in Regulation 85, along with a uniform and rations or an allowance in lieu, as approved by the Minister (Regulation 85(a)). This regulation aims to ensure that those involved in the training of instructional staff are adequately compensated for their service.
The Provisional Regulation imposes specific obligations on the parties involved, primarily focusing on the financial and allowance aspects for personnel within the Special School of Instruction. The regulation mandates that the pay, uniform, and rations or allowance for these personnel must adhere to the prescribed minimum rates and conditions as set out in Regulation 85. Additionally, the approval of the Minister is required for any variations in the allowance provided, ensuring a level of oversight and control over the financial distribution within this educational framework.
In terms of consequences for breach, the Provisional Regulation does not explicitly outline offences, penalties, or civil/criminal consequences for non-compliance within the text provided. However, it is implied that any failure to adhere to the prescribed pay rates, uniform, and allowance provisions could potentially lead to legal repercussions under the Defence Act 1903-1910. The specific penalties for such breaches would likely be determined by the broader legislative framework and administrative regulations governing military forces at the time.
