Overview
The Statutory Rules 1914 No. 81, Provisional Regulations under the Defence Act 1903-1912, specifically address amendments to the Financial and Allowance Regulations for the Military Forces of the Commonwealth, coming into operation from 1 January 1914. This legislative instrument was enacted by the Governor-General in Council, reflecting the urgency and importance of the amendment. The objective of these regulations is to ensure proper financial administration and allowances for military personnel, thereby supporting the operational readiness and efficiency of the military forces. The regulation serves to modify existing provisions to align with current requirements and operational standards, as necessitated by the evolving needs of the military.
Scope and Application
The Provisional Regulations under the Defence Act 1903-1912, specifically concerning the financial and allowance regulation for the military forces of the Commonwealth, outline amendments pertinent to the members of the military, particularly those in the Militia Field Artillery who participated in the practice camp of the Royal Australian Field Artillery held at National Park in the 2nd Military District during November and December 1912. These regulations apply directly to such officers, governing their eligibility and entitlement to allowances as prescribed within the regulation. However, the amendment cancels a previous sub-paragraph which had excluded the necessity for these officers to obtain a 'passed' or higher certificate to be eligible for the allowance. The regulations, having been enacted with urgency, are applicable nationally and are designed to govern the financial matters of military personnel under the Commonwealth’s Defence Act, ensuring consistency and fairness in the application of allowances across the military forces.
Key Provisions
The main operative sections of the Statutory Rules 1914, No. 81, involve an amendment to Regulation 222 under the Defence Act 1903-1912, specifically concerning financial and allowance regulations for the Military Forces of the Commonwealth. Regulation 222(1) is amended to remove a sub-paragraph that previously exempted certain officers of the Militia Field Artillery from the requirement of obtaining a 'passed' or higher certificate to be eligible to draw an allowance. This change means that all officers of the Military Forces of the Commonwealth will now need to meet the specified certification requirements to draw allowances as prescribed in Regulation 222(1).
The obligations and requirements imposed by the amended Regulation 222(1) on the parties it governs are primarily focused on ensuring that all officers of the Military Forces of the Commonwealth, including those who attended the practice camp of the Royal Australia Field Artillery in November and December 1912, must meet the certification criteria to be eligible for the allowance. This amendment ensures consistency in the application of financial and allowance regulations across all military officers, removing any exceptions that previously existed for specific groups.
In terms of potential offences and penalties for breaches of the amended Regulation 222(1), the statutory rules do not explicitly state any specific offences or penalties for non-compliance. However, any officer who fails to meet the new certification requirements to draw allowances could potentially face administrative or disciplinary action under other provisions of the Defence Act 1903-1912 or related military regulations. The absence of explicit penalties in the Statutory Rules 1914, No. 81, suggests that the focus of this amendment is on clarifying and standardising the eligibility criteria for allowances, rather than introducing new punitive measures.
