Overview
The Provisional Regulations under the Defence Acts 1903-1904, issued in 1910, were introduced to address the urgent need for updated financial and allowance regulations for members of the Australian Military Forces. The enacting body was the Governor-General in Council, acting on behalf of the Commonwealth of Australia, and the policy objective was to ensure fair compensation and allowances for military personnel, specifically addressing the unique conditions faced by those stationed in tropical climates. The regulations provided for extra pay, known as Tropical Pay, for certain military ranks stationed in specific locations, such as Thursday Island and Townsville, and also adjusted the pay rates for Warrant Officers and Non-Commissioned Officers, effective from 1 July 1910. Additionally, the regulations introduced District Allowances for military personnel residing in areas approved under Public Service Regulations.
Scope and Application
The Statutory Rules 1910 No. 84, Provisional Regulations under the Defence Acts 1903-1904, pertains to financial and allowance regulations for the military forces of the Commonwealth, specifically targeting members of the Royal Australian Artillery stationed at Thursday Island and Townsville. These regulations govern the extra pay, termed Tropical Pay, which is granted to certain ranks of military personnel who are not receiving a consolidated rate of pay, with those in receipt of consolidated rates being eligible for District Allowances as per Regulation 159a. Additionally, the regulations outline the rates of pay for warrant officers and non-commissioned officers, inclusive of all allowances except travelling and horse allowances, effective from 1st July 1910. The regulations apply to the entire Commonwealth of Australia and are binding on all relevant military personnel. Notably, the regulations do not specify exclusions or exemptions, and their application may be extended or restricted through subordinate instruments.
Key Provisions
The Statutory Rules 1910 No. 84, Provisional Regulations under the Defence Acts 1903-1904, introduce several key amendments to financial and allowance regulations for the military forces. Section 63 replaces the previous provision concerning Tropical Pay, now specifying that members of the Royal Australian Artillery stationed at Thursday Island and Townsville, who are not receiving a consolidated rate of pay, are eligible for additional compensation. The rates vary depending on rank, with Battery Sergeant-Majors receiving 1s.8d. per diem at Thursday Island and 9d. per diem at Townsville, while other ranks such as Sergeants, Corporals, Bombardiers, and Gunners receive lesser amounts. Those in receipt of a consolidated rate of pay will instead receive District Allowances, as detailed in Regulation 159a.
Regulation 77 modifies the pay for Warrant Officers and Non-Commissioned Officers, including instructional staff, effective from 1 July 1910. The new rates are consolidated and inclusive of all allowances except for travelling and horse allowances. Warrant or Non-Commissioned Officers who were appointed prior to the regulations' effective date and are receiving a salary higher than what is now stipulated for their classification will continue to receive their current salary until they are promoted to a class with an equivalent or higher salary. This provision ensures a fair transition for existing personnel while standardising pay rates.
The newly introduced Regulation 159a mandates that District Allowances, based on the same scale as those paid to members of the Commonwealth Public Service, be provided to all members of the Permanent Military Forces who are in receipt of consolidated rates of pay. These allowances are subject to the conditions outlined in Public Service Regulations 168 and 169. This regulation ensures that military personnel residing in districts for which District Allowances have been approved receive the same benefits as their public service counterparts.
In terms of compliance, the parties governed by these regulations, primarily military personnel and their administrative bodies, must adhere to the specified pay rates and allowances. For instance, military finance departments must ensure that eligible personnel receive the correct Tropical Pay or District Allowances based on their rank and location. Non-compliance could lead to financial discrepancies and dissatisfaction among the ranks.
Breaches of these regulations could have serious consequences. While the specific penalties are not detailed in the text, breaches of military regulations generally carry both civil and criminal penalties. Civil penalties might include fines or the withholding of pay, while criminal penalties could result in more severe sanctions, including imprisonment, depending on the severity and intent of the breach. The maximum penalties would be in accordance with the general military law and the Defence Act 1903-1904.
