The grade of a member under the provisions of this Regulation shall be that corresponding to this designation, provided that a member who is receiving at the date of the Regulation a salary less than the minimum amount of such grade may be granted annual additions of salary of an amount to be determined by the Minister until the salary reaches such minimum, and provided further that where the same designation occurs in two or more grades the grade of the member shall be that corresponding, or most nearly corresponding, in rate of pay to the grading of his office prior to the issue of this Regulation.

Deduction for quarters.

When public quarters are allotted to a member of the Ordnance Department or Rifle Range Services, a deduction of one-tenth shall be made from his pay.

Overview

The Statutory Rules 1911 No. 27, provisional regulations under the Defence Act 1903-1910, were introduced by the Governor-General in the Federal Executive Council to address the urgent need for financial and allowance regulations for the military forces of the Commonwealth. These regulations, which came into immediate effect on the first day of January 1911, were aimed at providing structured grade arrangements and salary limits for the Ordnance Department and Rifle Range Services personnel, excluding those under the Public Service Act. The policy objective was to ensure a fair and systematic approach to the remuneration of military staff, while also providing provisions for increments based on service duration and office classification. The enactment of these regulations was crucial for maintaining discipline and morale within the military forces by providing clear guidelines for salaries and increments.

Scope and Application

The Provisional Regulations under the Defence Act 1903-1910 pertain specifically to financial and allowance regulations for the military forces of the Commonwealth, with a particular focus on the Ordnance Department and Rifle Range Services. These regulations apply to members of the Ordnance Department and Rifle Range Staffs, excluding those who serve under the Public Service Act. The regulation sets out a structured grading system for positions within these services, with specific minimum and maximum salaries, and outlines the conditions under which salary increments are awarded, including annual and biennial increments. The regulations also address the circumstances under which deductions from salary might occur, such as when public quarters are provided. The application of these regulations is confined to the Commonwealth jurisdiction, and they are designed to come into immediate operation, effective from the first day of January 1911, as certified by the Governor-General.

Key Provisions

The main operative sections of the Provisional Regulations under the Defence Act 1903-1910 (Regulation No. 81) establish a structured grading system for members of the Ordnance Department and Rifle Range Staffs, excluding those serving under the Public Service Act. These positions are categorised into various grades, each with specified minimum and maximum salaries and incremental increases (Regulation 81). The grades range from III to X, with each grade having a defined minimum salary, annual or biennial increments, and maximum salary limits (C.3803). Members in possession of a higher rate of pay prior to these regulations will continue to receive it while they hold their respective offices. Advancement through these grades is contingent on vacancies and the material change in the duties of an office (Regulation 81). Additionally, the regulation provides for the possibility of granting increments that may have been deferred (Regulation 81). The obligations imposed by these regulations include the classification of positions within the Ordnance Department and Rifle Range Staffs into specific grades, ensuring that each member's salary aligns with the prescribed limits for their grade (Regulation 81). Members must adhere to the conditions for advancement between grades, which depend on the availability of vacancies or changes in the classification of their office (Regulation 81). If a member's salary is below the minimum for their designated grade at the time of the regulation's enactment, they are entitled to annual salary additions until they meet the minimum (Regulation 81). Moreover, when members are provided with public quarters, a deduction of one-tenth of their pay is mandated (C.3803). Breaches of these financial and allowance regulations may result in civil or administrative consequences, as the regulations are designed to govern the financial aspects of military service. However, the specific penalties for non-compliance are not detailed within the provided text. The overarching intent of these regulations is to ensure orderly and equitable remuneration practices within the Ordnance Department and Rifle Range Staffs, maintaining both fairness and efficiency in the compensation structure.
