Overview

The Statutory Rules of 1911, No. 162, introduces Provisional Regulations under the Defence Act 1903-1910, specifically amending Financial Regulation 107. This legislative instrument was enacted to address an urgent need for financial management within the military forces, particularly concerning the payment schedules for members of the Militia Staffs. Enacted by the Governor-General in accordance with the Defence Act 1903-1910, the policy objective of this amendment was to ensure that financial regulations are efficiently applied and enforced, reflecting the seriousness of military service attendance and its impact on remuneration. The regulations were designed to provide a structured approach to financial allowances and penalties based on the attendance and efficiency of military personnel during their training camps.

Scope and Application

The Statutory Rules 1911 No. 162, under the Defence Act 1903-1910, pertains to the Financial and Allowance Regulations (Provisional) for the Military Forces of the Commonwealth. This regulation specifically addresses the financial remuneration of members of the Militia Staffs, determining the conditions under which their pay is disbursed. It applies to members of the Militia Staffs within the Commonwealth of Australia, governing their payment schedules based on attendance and efficiency at the Annual Camp of Continuous Training. The regulation stipulates that half of their annual pay should be distributed upon completion of the Annual Camp, with the remaining balance being split into two payments at the ends of December and June. However, if a member fails to attend the Annual Camp for the full period required by efficiency regulations, they forfeit a proportional amount of their pay for each day of absence. This regulation is designed to ensure that only those members who meet the required attendance and efficiency standards are compensated fully for their service. The scope of these Provisional Regulations is confined to the Commonwealth, impacting the financial management of the military forces directly under federal control. While the regulations are primarily concerned with financial matters, they also indirectly influence the operational efficiency and discipline of the Militia Staffs. The regulation extends its application to all members of the Militia Staffs who are subject to the efficiency regulations, ensuring a uniform approach to pay distribution. There are no stated exclusions or exemptions within the regulation itself, but it is subject to the overarching provisions of the Defence Act 1903-1910 and any subsequent amendments or interpretations that may arise from that Act. Additionally, the regulation may be subject to further refinement or clarification through subordinate instruments issued under the authority of the Defence Act.

Key Provisions

The main operative sections of this legislation are included in the Financial and Allowance Regulations (Provisional) for the Military Forces of the Commonwealth. Specifically, the amendment to Regulation 107 (sub-paragraph (b)) modifies the payment schedule for members of the Militia Staffs. According to the amendment, one half of the annual rate of pay is to be paid to members at the conclusion of the Annual Camp of Continuous Training. The remaining balance is to be paid in two instalments, one half at the end of December and the other half at the end of June each financial year. However, if a member does not attend the Annual Camp of Training for the full period required to be classified as efficient, a proportionate amount of the pay for the Camp of Training is to be forfeited for each day of absence (Regulation 107). The amendment imposes specific obligations on the members of the Militia Staffs regarding their attendance and punctuality during the Annual Camp of Continuous Training. Members are required to attend the camp for the full period mandated by the efficiency regulations to avoid forfeiture of their pay. This regulation aims to ensure that members are adequately trained and efficient, thereby maintaining the overall effectiveness and readiness of the military forces. Moreover, the regulation outlines a structured payment schedule, providing financial stability and predictability for the members throughout the financial year. Breaches of this regulation may result in financial consequences for the members who fail to meet the attendance requirements during the Annual Camp of Continuous Training. Specifically, members who do not attend the camp for the full required period will forfeit a proportionate amount of their pay for each day of absence. This penalty is intended to enforce discipline and ensure compliance with the training requirements set forth in the efficiency regulations. The maximum penalty for non-attendance would be the total forfeiture of the pay allotted for the Camp of Training, contingent on the member's absence for the entire duration of the required attendance period.
