Overview
The Statutory Rules 1907 No. 1, Provisional Regulations under the Defence Acts 1903–1904, were enacted to address immediate operational needs in the management and regulation of military forces' financial and allowance matters within the Commonwealth of Australia. These regulations were introduced by the Governor-General, acting with the advice of the Federal Executive Council, and came into immediate operation due to the urgency of the matters they sought to resolve. The policy objective, while not explicitly stated in the text, is inferred to be the efficient and timely regulation of financial and allowance matters for military forces, ensuring they align with broader treasury regulations. This legislative instrument reflects the early legislative efforts to establish a structured framework for the financial administration of the military, adapting to the unique needs of the time.
Scope and Application
The Provisional Regulations under the Defence Acts 1903–1904 apply to the military forces of the Commonwealth of Australia, including all personnel, entities, and conduct related to the defence forces. These regulations establish financial and allowance standards, which are crucial for the proper administration and support of the military. The geographic reach of this legislation is national, encompassing all military forces within the Commonwealth of Australia. The regulations have been expedited into effect due to their urgency, as they pertain to the immediate needs of the military. They extend and refine the application of existing financial and allowance regulations by substituting specific clauses with Treasury Regulations, particularly referencing Treasury Regulation 137, thereby ensuring that the financial management and allowances for military personnel are up to date and aligned with broader fiscal policies. These regulations are intended to provide a streamlined and efficient framework for the financial administration of the military forces.
Key Provisions
The primary sections of the Provisional Regulations under the Defence Acts 1903–1904 (C1907L00001) primarily focus on the financial and allowance regulations for the Military Forces of the Commonwealth. Specifically, section 45 mandates the deletion of certain words from Clause 7n, replacing them with reference to "Treasury Regulation 137." Similarly, section 47 also requires the same deletion and substitution in Clause 7n. Section 49 involves the amendment of the first line by replacing the words "Public Service Regulations" with "Treasury Regulations." These sections ensure that the financial and allowance regulations align with the latest Treasury regulations, thereby providing a clear and updated framework for the financial governance of military forces.
The obligations imposed by these regulations on the parties or entities they govern are primarily administrative in nature. They require entities involved in the financial and allowance management of the Military Forces to adhere to the specified Treasury Regulations. This includes ensuring that financial transactions, allowances, and related procedures comply with the updated regulatory standards. The regulations mandate that any amendments or deletions must be accurately implemented, reflecting the new references to Treasury Regulation 137 and ensuring that the terminology used is consistent with the latest administrative practices.
Breaches of these regulations could lead to various consequences, though the specific penalties are not detailed within the legislative instrument. Given the nature of the regulations, non-compliance could potentially result in financial mismanagement or inaccuracies in the allowance distribution for military personnel. While the exact penalties are not specified, it is reasonable to infer that serious breaches might lead to administrative sanctions, financial penalties, or even disciplinary actions against those responsible for ensuring compliance. The precise legal consequences would likely depend on the severity and impact of the breach, as well as any relevant administrative or military disciplinary codes.
