Overview

The Financial and Allowance Regulations for the Military Forces of the Commonwealth, 1916, was introduced as a legislative instrument under the Defence Act 1903–1915, addressing the need for adjustments in financial and allowance regulations during the period of war. The instrument was enacted by the Governor-General in Council and aims to provide flexibility and timely adjustments to the financial management of military forces, including provisional approval of store write-offs, amendments to pay scales, and allowances for instructional staff. The policy objective was to ensure that the military forces could be adequately supported and managed during wartime by providing necessary financial and administrative adjustments.

Scope and Application

The Financial and Allowance Regulations for the Military Forces of the Commonwealth, as amended by these statutory rules, apply to members of the Australian military, specifically targeting warrant officers, non-commissioned officers, and men. The amendments outlined within these regulations extend to the allowances and financial provisions for various roles within the military hierarchy, such as company sergeant-majors, assistants military foremen of works, and inspecting ordnance officers. These regulations are framed under the Defence Act 1903–1915 and pertain to the Commonwealth of Australia, thereby applying nationally across the federal jurisdiction. Notably, certain amendments are contingent upon the period of the war, such as the provisional approval of the writing off of stores and allowances for instructional duties, and these provisions are subject to subsequent covering approval from headquarters. The amendments to specific regulations, such as the insertion of new roles and adjustments to allowances, have been scheduled to take effect from specified dates in 1916, ensuring a phased implementation of the changes.

Key Provisions

The Financial and Allowance Regulations for the Military Forces of the Commonwealth, as amended, primarily modify provisions related to the approval of store write-offs, the pay of certain military personnel, and allowances for instructional duties. Regulation 5 now allows District Commandants to provisionally approve the writing off of stores up to £20 during the war period, but requires a monthly report to Headquarters if the amount written off exceeds £5. Regulation 78 alters the pay structure by inserting "Assistant Military Foreman of Works" under "Company Sergeant-Major" and "Sergeant," effective from 1 May 1916. Regulation 99 increases the annual pay of an "Inspecting Ordnance Officer" to £50 and removes the former rate of £25, effective from 1 July 1916. Regulation 231 replaces the allowance for instructional staff with one specifically for Warrant and Non-commissioned Officers of the permanent Military Forces who are employed on instructional duties at A.I.F. Camps, effective from 1 December 1915. These amendments impose specific obligations on military personnel and administrative staff. District Commandants must ensure that any provisional approval of store write-offs exceeding £5 is reported to Headquarters monthly. The new allowances for Assistant Military Foremen of Works and Inspecting Ordnance Officers must be implemented in accordance with the specified dates. The changes to allowances for instructional duties ensure that only those Warrant and Non-commissioned Officers specifically employed at A.I.F. Camps during the war period are eligible for the revised allowance. Breach of these regulations could result in various civil or administrative consequences. For instance, failure to report store write-offs as required could lead to administrative penalties or scrutiny from higher authorities. Not adhering to the specified pay rates could result in underpayment or other financial discrepancies, potentially leading to legal action. Non-compliance with the allowance provisions might result in improper financial benefits being granted or withheld, which could also have legal ramifications. The specific penalties are not detailed in the text, but they could include fines, repayment of improperly granted allowances, or other corrective actions as deemed necessary by the relevant authorities.
