Overview

The Statutory Rules 1925, No. 82, titled "Regulations Under the Defence Act 1903-1918," was enacted to amend existing financial and allowance regulations for the Australian Military Forces and Senior Cadets. This legislative instrument was introduced to address gaps in the financial and administrative management of military personnel, particularly concerning the calculation of service increments and deferments. The Governor-General, acting on advice from the Federal Executive Council, issued these regulations to come into effect from 1 July 1924. The objective of these amendments was to ensure that periods of deferment approved prior to the specified date are factored into the reckoning of service for increments, except those related to failure to pass an examination for promotion. This ensures consistency and fairness in the application of financial allowances within the military framework.

Scope and Application

The Financial and Allowance Regulations for the Australian Military Forces and Senior Cadets, 1921, under the Defence Act 1903-1918, applies to members of the Australian Military Forces and senior cadets. These regulations encompass the financial and allowance-related aspects of military service, ensuring that the provisions set forth are applicable to all individuals who fall under these categories. The regulations extend across the Commonwealth of Australia, thereby applying to all states and territories within the nation, and are designed to govern the financial matters of military personnel and their allowances comprehensively. Notably, the regulations include provisions for the inclusion of periods of deferment approved before 1 July 1924 in reckoning service for the purposes of calculating increments, except those relating to failure to pass an examination for promotion. The scope of these regulations can be further extended or refined through subordinate instruments, which may include additional rules or clarifications to ensure effective implementation and compliance.

Key Provisions

The key operative sections of the Statutory Rules 1925, No. 82, which are the Regulations under the Defence Act 1903-1918, pertain to financial and allowance regulations for the Australian Military Forces and Senior Cadets, 1921. These regulations provide a framework for the financial management and allowances applicable to the military personnel and senior cadets. The regulations are detailed in Statutory Rules 1921, No. 82, as amended to this date. A notable amendment involves the inclusion of deferment periods approved before 1 July 1924 in reckoning service for the purposes of increment determinations, excluding those related to failure to pass a promotion examination. The regulations impose several obligations and requirements on the parties or entities they govern. Firstly, they mandate that the service of military personnel and senior cadets be accurately recorded and that any periods of deferment approved prior to 1 July 1924 be factored into the reckoning of service for increment purposes. This ensures that the service duration is accurately reflected in the calculation of financial entitlements. Additionally, the regulations require adherence to the specific criteria for determining increments, particularly excluding those increments that relate to the failure to pass a promotion examination. This specificity ensures that the financial benefits and progression within the military structure are based on performance and qualifications rather than arbitrary deferments. There are no explicit offences, penalties, or civil/criminal consequences mentioned in the provided text for breach of the regulations. However, non-compliance with these financial and allowance regulations could potentially lead to administrative or disciplinary actions within the military framework, as they are crucial for maintaining the integrity of the financial and service records of military personnel and senior cadets. The regulations' primary focus is on ensuring accurate record-keeping and fair determination of allowances and increments, which are fundamental to the operational efficiency and morale of the Australian Military Forces and senior cadets.
