Overview

The Statutory Rules 1921, No. 236, are Regulations under the Defence Act 1903-1918, enacted to address the administrative and financial management of the Australian Military Forces and Senior Cadets. These regulations were made by the Governor-General in Council, with Granville Ryrie acting as the Minister of State for Defence. The overarching policy objective of these regulations is to ensure efficient and fair financial management within the Australian Military Forces by detailing allowances and financial practices. The regulations cover a range of areas including training deductions, rank allowances, payment schedules, and allowances for the use of personal vehicles on official duties. These amendments and additions to existing financial and allowance regulations aim to provide clarity and consistency in the financial dealings of the military personnel, ensuring that the financial management aligns with the operational needs and fairness to the personnel involved.

Scope and Application

The Financial and Allowance Regulations for the Australian Military Forces and Senior Cadets, 1921, as amended by these regulations, apply to the financial and allowance provisions for members of the Australian Military Forces, including Senior Cadets. The amendments touch on various aspects of financial management within the military, such as pay deductions for specific courses, adjustments in payment rates for certain ranks and appointments, changes in the frequency of payments, and allowances for the use of personal vehicles for official duties. These regulations extend to the Commonwealth of Australia and are made under the Defence Act 1903-1918. The regulations cover the financial and allowance practices specific to military personnel and their roles, including deductions, allowances, and payments structured to meet the operational needs of the military forces. The changes are effective from specific dates as noted within the regulation, ensuring that the amendments are implemented in a timely and structured manner.

Key Provisions

The Financial and Allowance Regulations for the Australian Military Forces and Senior Cadets, 1921, as amended by Statutory Rules 1921 No. 236, introduce several key changes. Regulation 34 is amended to specify that a sum of seven shillings per week will be deducted from the pay of men enlisted in the Australian Instructional Corps who undergo a training course at the Central Training Depot. This deduction continues for the duration of the course, with arrears payable upon course completion. However, soldiers who desert or are discharged before completing the course forfeit these arrears unless approved by the Military Board. The deduction does not apply to members of other units of the Permanent Forces attending the course in preparation for transfer to the Australian Instructional Corps. Regulation 68 is adjusted to renumber some entries and remove others, ensuring the list of allowances is up-to-date and accurate. Regulation 100 is expanded to include new positions such as Assistant Director of Medical Services and Deputy Assistant Director of Medical Services, with specified rates for their additional duties. Regulation 122 modifies the payment schedule for personnel, changing it from half-yearly to quarterly payments, effective from July 1, 1921. Regulation 201 revises the conditions under which members can claim allowances for using their own vehicles on official duties, stipulating that such allowances are contingent on the use of the vehicle for duties that cannot be performed by other means and that free petrol issues are not provided. These amendments impose clear obligations on the Australian Military Forces and Senior Cadets regarding financial deductions, payment schedules, and allowable reimbursements for official duties. Members of the Australian Instructional Corps must accept the specified deductions during their training period, and those using personal vehicles for official duties must adhere to the updated allowance rules. The regulations ensure transparency and fairness in financial dealings within the military. The changes to payment schedules in Regulation 122 require adherence to the new quarterly payment system for personnel, while the introduction of new positions in Regulation 100 mandates the provision of appropriate allowances for these roles. Violation of these financial and allowance regulations can lead to significant consequences. For instance, soldiers who desert or are discharged before completing their training course and thus forfeit their arrears may face disciplinary action. Additionally, misuse of personal vehicles for official duties without proper approval or exceeding allowable reimbursements can result in financial penalties. The regulations do not specify exact penalties for non-compliance, but breaches may lead to administrative actions or financial recoupment by the military authorities. The seriousness of the consequences depends on the nature and extent of the breach, but the regulations aim to ensure strict adherence to the financial guidelines set forth.
