Overview

The Statutory Rules of 1934, No. 20, made under the Defence Act 1903-1932, introduce amendments to the financial and allowance regulations for the Australian Military Forces and Senior Cadets. Enacted by the Governor-General in Council, these regulations aim to address variations in the cost of living by adjusting the pay of members of the Permanent Military Forces accordingly. The policy objective is to ensure that military pay reflects changes in the cost of living, thereby maintaining the purchasing power of military personnel. The regulations also modify provisions related to child endowment payments and deductions for cooked rations, ensuring that these allowances adjust in line with changes in pay. This legislative instrument was designed to maintain fair compensation for military members amidst economic fluctuations.

Scope and Application

The Financial and Allowance Regulations for the Australian Military Forces and Senior Cadets, made under the Defence Act 1903-1932, govern the financial aspects of the remuneration and allowances for members of the Permanent Military Forces, excluding those paid on the basis of wages paid for a similar class of employment in outside trade establishments. These regulations apply to the Commonwealth and its military personnel, ensuring that their pay is adjusted in accordance with variations in the cost of living as determined by the retail price index number published by the Commonwealth Statistician. The regulations also cover specific amendments to child endowment payments, adjustments to deductions for cooked rations, and deductions for unmarried other ranks based on variations in pay. Any variations in pay, as stipulated in the regulations, take effect on the first day of July following the notification of the index number and remain in force for a period of twelve months. The regulations do not extend to the pay of members who are remunerated on terms equivalent to outside trade establishments.

Key Provisions

The main operative sections of the Regulations under the Defence Act 1903-1932, particularly focusing on the Financial and Allowance Regulations for the Australian Military Forces and Senior Cadets, establish procedures for varying the pay of members of the Permanent Military Forces based on the cost of living (Regulation 24a). Regulation 24a (i) mandates that the pay of these members should be adjusted according to the retail price index number for six State capital cities published by the Commonwealth Statistician. The variation in pay is determined by specific reduction or increase rates corresponding to the index number, which should be effective from the first day of July following the notification in the Gazette and remain in force for twelve months. Additionally, Regulation 50 has been amended to require written applications for Child Endowment, with retrospective payments allowed for members serving abroad. Regulation 52 has been updated to change the monetary amount for certain deductions and to stipulate that these deductions should also vary according to changes in a member’s pay. Furthermore, Regulation 54 has been amended to specify that deductions for unmarried other ranks should be proportionately adjusted based on changes in their pay as per Regulation 24a. The Regulations impose several obligations on the parties involved, particularly focusing on the administrative processes regarding pay and allowances. Members of the Permanent Military Forces must submit written applications for Child Endowment, ensuring they adhere to the new stipulations regarding the timing and duration of such payments. The Military Board is responsible for deciding the actual increase or decrease in deductions as per Regulation 54. The Commonwealth Statistician is tasked with publishing the retail price index numbers, which are crucial for determining pay variations according to Regulation 24a. These Regulations also mandate that any changes in pay, as outlined, should be communicated effectively to all relevant personnel and enforced consistently. The Regulations stipulate certain consequences for non-compliance. While the text does not explicitly mention penalties for breaching these provisions, it is implied that adherence to the stipulated procedures for pay adjustments and allowance deductions is crucial. Non-compliance with the written application requirement for Child Endowment or the stipulated timing and duration of payments could potentially lead to the withholding of such benefits. Additionally, failure to adjust pay and related deductions in accordance with the specified index numbers and corresponding rates could result in administrative discrepancies and potential legal repercussions. The precise penalties are not detailed in the provided text, but breaches could likely lead to disciplinary actions or other corrective measures within the military framework.
