Overview
The Statutory Rules 1931, No. 51, enacted under the Defence Act 1903-1927, address the need for financial and allowance regulations for the Australian Military Forces and senior cadets. This legislation was introduced to ensure that the Australian military personnel are provided with appropriate financial support and allowances during their service. The regulations were made by the Governor-General of the Commonwealth of Australia, acting on the advice of the Federal Executive Council, and came into operation immediately, except for Regulation 107, which was set to commence on 31 January 1931. The objective of these regulations is to provide clarity and consistency in the financial support system for military personnel, including modifications to allowances and grants for voluntary aid detachments, which are essential for the administrative and operational efficiency of the Defence Force.
Scope and Application
The Statutory Rules 1931, No. 51, made under the Defence Act 1903-1927, pertain specifically to financial and allowance regulations for the Australian Military Forces and senior cadets. These regulations outline the financial provisions and allowances applicable to members of the Australian Military Forces and senior cadets, detailing the structure and administration of these allowances, including modifications to existing regulations and the introduction of new provisions. The scope of the Act encompasses both individuals and entities involved in the Australian Military Forces and senior cadet programs, with a focus on ensuring appropriate financial support and administrative management within these groups. The regulations apply on a national level within Australia, ensuring uniform application across the Commonwealth.
The regulations extend to members of the Australian Military Forces and senior cadets, detailing allowances, financial support, and administrative expenses. Notably, the Act includes provisions for grants to State Joint Councils of Voluntary Aid Detachments, subject to parliamentary approval, to cover expenses related to the registration of members and other administrative costs. The regulations also modify existing provisions and introduce new allowances, reflecting changes in the operational requirements and financial support structures for military personnel and cadets. While the primary application is within Australia, the specific allowances and administrative procedures outlined are designed to ensure consistent and effective support across all states and territories.
Key Provisions
The statutory rules (Statutory Rules 1931, No. 51) primarily amend the financial and allowance regulations for the Australian Military Forces and senior cadets, implementing changes under the Defence Act 1903-1927. Regulation 107 is specifically altered to clarify the conditions for absence during a camp period, while Regulation 159's figures are removed and Regulation 161 is renumbered as Regulation 160. Additionally, a new Regulation 161 is introduced, permitting a grant of one shilling per annum per enrolled efficient member to State Joint Councils of Voluntary Aid Detachments for administrative expenses, subject to parliamentary provision.
These regulations impose several obligations on the involved parties. For example, Regulation 107 now explicitly details the permissible absences during camp periods, providing clarity for service members and military authorities. Furthermore, the financial obligations outlined in the new Regulation 161 require the Department of Defence to manage the grant payments to Voluntary Aid Detachments, ensuring that funds are allocated as per the approved establishments. These amendments and additions necessitate careful compliance and adherence to the newly specified conditions and administrative protocols.
Failure to comply with these regulations may result in various consequences. While specific offences and penalties are not detailed within the provided text, it is reasonable to infer that breaches of these financial and allowance regulations could lead to administrative penalties or legal actions under the Defence Act 1903-1927. The nature and extent of penalties would typically depend on the severity and impact of the non-compliance, potentially including fines or other corrective measures as prescribed by the relevant legislation.
