Overview
The Statutory Rules 1933 No. 18, titled "Regulations under the Defence Act 1903-1932," was enacted to provide for financial and allowance regulations for the Australian Military Forces and senior cadets. This legislative instrument amends previous regulations established under the Defence Act 1903-1932, reflecting the need to update and clarify the financial entitlements of certain ranks and appointments within the military structure. The regulations are made by the Deputy of the Governor-General, acting with the advice of the Federal Executive Council, and are designed to address specific gaps in the existing allowances for Bandmasters with honorary commissions. This legislative instrument aims to ensure that these personnel receive appropriate financial recognition for their roles and contributions within the military framework.
Scope and Application
The Regulations under the Defence Act 1903-1932, as detailed in Statutory Rules 1933 No. 18, primarily apply to members of the Australian Military Forces and senior cadets, including officers of various ranks such as Lieutenants and Bandmasters, as well as non-commissioned officers such as Brigade or Regimental Sergeant-Majors, Quartermaster-Sergeants, and Bandmasters holding honorary commissions. These regulations govern financial and allowance aspects pertinent to the military personnel and their duties. The application of these regulations is within the jurisdiction of the Commonwealth of Australia and are enforceable across all states and territories as part of the national Defence Act. The regulations provide detailed financial provisions and adjustments, ensuring that allowances are appropriately allocated based on rank and appointment. These amendments, effective immediately, involve specific insertions in the relevant regulations to account for Bandmasters with honorary commissions in the financial and allowance structures, thereby extending their application to this group.
Key Provisions
The primary operative sections of the Statutory Rules 1933, No. 18, under the Defence Act 1903-1932, amend Regulations 101 and 235 to include Bandmasters with honorary commissions in the financial and allowance structures for the Australian Military Forces and Senior Cadets. Specifically, Regulation 101 is amended to include Bandmasters with honorary commissions alongside other ranks such as Lieutenant and Brigade or Regimental Sergeant-Major, Quartermaster-Sergeant (paragraph 1). Furthermore, Regulation 235 is revised to include Bandmasters holding honorary commissions in the list of Other Officers, which already includes Quartermasters of the Permanent Military Forces (paragraph 2).
These amendments impose specific obligations and requirements on the parties governed by the Act. Firstly, Bandmasters with honorary commissions must now be included in the same financial and allowance considerations as other ranks mentioned in Regulation 101. This means they are entitled to the same benefits and allowances as their peers, ensuring equitable treatment within the military hierarchy (paragraph 3). Secondly, Regulation 235's amendment mandates that Bandmasters holding honorary commissions should be treated similarly to other officers, ensuring they receive appropriate financial and administrative considerations, including those related to their rank and duties (paragraph 4).
The Regulations also outline the consequences for breaches. While the Statutory Rules themselves do not explicitly state penalties for non-compliance, the overarching Defence Act 1903-1932 provides a framework for disciplinary and legal actions. Non-compliance with these financial and allowance provisions could potentially lead to administrative sanctions, including the withholding of allowances or financial benefits, and might also invoke disciplinary measures as per the Defence Act (paragraph 5). The exact penalties for breaches would depend on the specific provisions of the Defence Act, which could include fines, imprisonment, or other disciplinary actions deemed appropriate by the military authorities.
