Overview

The Financial and Allowance Regulations for the Military Forces of the Commonwealth of Australia, enacted in 1917, were introduced to provide a structured and equitable framework for the remuneration and allowances of military personnel within the Australian Defence Force. These regulations were established under the Defence Act 1903–1915 by the Federal Executive Council, with the aim of ensuring that military personnel receive fair and consistent compensation for their service. The overarching policy objective of these regulations is to maintain the efficiency and effectiveness of the military by providing appropriate financial incentives and allowances that reflect rank, responsibilities, and service conditions. The regulations establish detailed annual salary rates and increments for various ranks and roles within the Australian Army Ordnance Corps, including commissioned officers and non-commissioned officers, with specific provisions for those who are required to work away from home or who have reached certain age milestones. Allowances for married personnel and provisions for uniform issuance are also outlined, ensuring that all members of the military are compensated in a manner that recognises their contributions and supports their well-being.

Scope and Application

The Financial and Allowance Regulations for the Military Forces of the Commonwealth of Australia, established under the Defence Act 1903–1915, apply specifically to personnel within the Australian Army Ordnance Corps, including commissioned and non-commissioned officers and men. These regulations outline the annual consolidated rates of pay for various ranks and subdivisions within the corps, as well as the conditions for salary increments and allowances. Notably, the regulations specify that all new appointments to the corps must adhere to the minimum rates of pay prescribed, unless otherwise provided in the Australian Military Regulations. The scope of these regulations is geographically confined to the Commonwealth of Australia, and they do not extend to other military forces or civilian personnel. The regulations also detail the allowances for members working away from home and the conditions for salary increases based on marriage or reaching the age of twenty-one. Additionally, increments for commissioned ranks are subject to the provisions of Financial and Allowance Regulation 91, with special approval for annual increments for Lieutenants granted by the Minister.

Key Provisions

The main operative sections of this legislation establish the annual consolidated rates of pay for members of the Australian Army Ordnance Corps and Store Section. Regulation 98b (1) specifies the annual salaries for various ranks within the Australian Army Ordnance Corps, while Regulation 98b (10) outlines the annual salaries for various ranks within the Store Section. Regulation 98b (2) mandates that all new appointments to the Australian Army Ordnance Corps must be made at the minimum rate of pay prescribed in the regulation. Regulation 98b (3) provides an allowance for members who are required to work away from home during the first two years of their appointment, ensuring their total salary and allowance amount to £89 per annum. Regulation 98b (11) permits the counting of time served in a former office when reckoning the interval for increment where a member receives no increase of pay on transfer within their section of the corps. The legislation imposes several obligations and requirements on the parties or entities it governs. Firstly, Regulation 98b (2) mandates that all new appointments to the Australian Army Ordnance Corps must be made at the minimum rate of pay prescribed in the regulation. Secondly, Regulation 98b (3) requires that members who are required to work away from home during the first two years of their appointment be paid an allowance sufficient to make their total salary and allowance up to £89 per annum. Thirdly, Regulation 98b (4) through (9) detail the conditions under which non-commissioned officers and men may be advanced to the next higher subdivision or receive increments in salary. Fourthly, Regulation 98b (10) specifies the annual salaries for various ranks within the Store Section, while Regulation 98b (11) permits the counting of time served in a former office when reckoning the interval for increment where a member receives no increase of pay on transfer within their section of the corps. The legislation includes provisions for offences, penalties, or civil/criminal consequences for breach. However, the text does not provide specific details regarding any such consequences. It is important to note that the absence of explicit penalties in the text does not necessarily mean that there are no consequences for non-compliance. Further investigation into the Defence Act 1903–1915 or related legislation may be necessary to determine any potential penalties or consequences for breach of these regulations.
