Overview

The Statutory Rules 1932, No. 88, made under the Defence Act 1903-1927, were enacted to establish financial and allowance regulations for the Australian Military Forces and Senior Cadets. These regulations were introduced by the Governor-General in Council, as per the authority granted by the Defence Act, to provide a structured financial framework governing the management of funds within the military. The policy objective, as implied by the regulations, is to ensure the efficient and effective management of financial resources allocated to the establishment and maintenance of Permanent Forces Officers’ and Sergeants’ Messes and Permanent Forces Military Institutes. This includes the creation of the Permanent Military Forces Messes and Institutes Fund, which is to be administered by the Military Board, to support various collective benefits and financial assistance to military members.

Scope and Application

The Statutory Rules 1932, No. 88, made under the Defence Act 1903-1927, primarily concern financial and allowance regulations for the Australian Military Forces and senior cadets. These regulations apply to the Australian Military Forces and senior cadets, encompassing aspects such as the establishment, maintenance, and financial management of Permanent Forces Officers’ and Sergeants’ Messes and Permanent Forces Military Institutes. The scope of these regulations extends to the creation and administration of the Permanent Military Forces Messes and Institutes Fund, which is used to provide financial assistance for the aforementioned messes and institutes, as well as for collective benefits to members of the Permanent Forces. The regulations also outline procedures for the management of the fund, including contributions, investments, and withdrawals, all of which are subject to the direction of the Military Board. The application of these regulations is national, as they are issued under Commonwealth authority. Subordinate instruments may further extend or restrict the application of these regulations, but the primary legislative instrument governs the overall framework and intent of financial and allowance regulations within the Australian Military Forces.

Key Provisions

The Regulations under the Defence Act 1903-1927, particularly Statutory Rules 1926, No. 211, as amended, provide several key provisions that govern financial and allowance regulations for the Australian Military Forces and Senior Cadets. Section (1) amends Regulation 208 by adding "and personnel required by the regulations to attend" at the end of paragraph (g). Regulation 318 is cancelled, and Regulation 319 is re-numbered as 318. Additionally, a new Regulation 319 is inserted, establishing the Permanent Military Forces Messes and Institutes Fund. This fund is intended to manage and allocate assets and surpluses from the closing down of Permanent Forces Officers’ or Sergeants’ Messes or Permanent Forces Military Institutes, and contributions from the net annual profits of such messes or institutes. The obligations imposed by these Regulations include the realisation of assets upon the closure of Permanent Forces Officers’ or Sergeants’ Messes or Permanent Forces Military Institutes, with any surplus paid into the fund. The fund's management and contributions are directed by the Military Board, which also determines the allocation of funds for purposes such as establishing new messes or institutes, assisting financially weak memberships, and providing collective benefits to members of the Permanent Forces. Furthermore, the fund's moneys must be deposited into a Commonwealth Savings Bank account, managed by officers appointed by the Military Board, with all monetary transactions recorded and audited annually. Breaches of these Regulations may lead to civil or criminal consequences, although the specific penalties are not detailed in the provided text. However, non-compliance with the directives of the Military Board concerning the management and allocation of funds could result in administrative or legal repercussions. The Regulations ensure that the fund is used strictly for its intended purposes, and any misuse or misappropriation of funds could lead to disciplinary action against those responsible.
