Overview

The Statutory Rules 1921 No. 146, Regulations under the Defence Act 1903-1918, were enacted to amend financial and allowance regulations for the Australian Military Forces and Senior Cadets. This legislation, made by the Governor-General in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, aims to adjust the payment rates and conditions for various ranks within the militia forces, ensuring the financial provisions align with the duties performed. These regulations were designed to establish clear guidelines for the payment of officers and personnel based on their specific roles and the hours worked, ensuring that compensation is fairly distributed according to service rendered.

Scope and Application

The Financial and Allowance Regulations for the Australian Military Forces and Senior Cadets, 1921, governs the remuneration and allowances for personnel within the Australian Military Forces and senior cadets. It applies to various ranks and positions within the militia forces, including commanders, staff officers, and warrant officers, detailing specific rates of pay and conditions under which these payments are made. The regulation is applicable nationwide as it is a Commonwealth instrument. Notably, the regulations detail specific requirements for the certification and documentation needed to substantiate claims for pay, such as the maintenance of diaries and obtaining certificates from commanding officers. The regulation also outlines specific exemptions and conditions for different categories of personnel, such as the pay conditions for members on leave or those attached to the Army Medical Corps. The application and interpretation of these regulations can be extended or restricted through subordinate instruments, as permitted under the Defence Act 1903-1918.

Key Provisions

The main operative sections of this legislation focus on the financial and allowance regulations for the Australian Military Forces and Senior Cadets. Specifically, Regulation 100 has been amended to revise the rates of pay for officers of the Militia Forces, including Divisional Commanders, Brigade Commanders, and various Staff Officers, with specific daily rates and maximum annual amounts prescribed. Regulation 101 has been updated to clarify the rates of pay for other personnel of the Militia Forces, excluding those mentioned in Regulation 100, with adjustments to the schedule of rates of pay and the roles of Assistant Adjutants, Quartermasters, and Warrant Officers. Additionally, Regulation 122 has been amended to detail the conditions under which the pay of Militia Staffs is issued, including requirements for certificates and diaries for various ranks and the method of payment. These regulations impose specific obligations on the relevant parties. For instance, Divisional and Brigade Commanders must produce a certificate supported by a maintained diary to verify the number of hours they have performed military duty, while Staff Officers must maintain a diary detailing their hours of employment and obtain certificates from their immediate Commanders. Similarly, Commanding Officers must provide certificates to substantiate the efficient performance of duties. These obligations ensure transparency and accountability in the payment process for military personnel. The legislation also outlines consequences for non-compliance. While the specific offences and penalties are not detailed in the text, it is reasonable to infer that failure to comply with these regulations could result in disciplinary action or other administrative consequences. The absence of explicit penalties in the text suggests that further investigation into related legislation or regulations may be necessary to fully understand the repercussions of non-compliance. However, the structured approach to payment conditions implies a formal process for addressing breaches, ensuring that military personnel are appropriately compensated while maintaining strict adherence to prescribed protocols.
