Overview

The Statutory Rules 1926, No. 67, titled "Regulations Under the Defence Act 1903-1918," was introduced to address administrative and financial issues within the Australian Military Forces and Senior Cadets. Enacted by the Governor-General in Council, the regulations amend existing financial and allowance provisions to enhance the efficiency and accountability of the military's financial management. The objective is to ensure that military personnel receive allowances and financial support in accordance with the stipulated regulations, while also maintaining proper auditing and financial oversight to prevent misuse of public funds. These regulations aim to streamline the administration of financial allowances and ensure that military personnel adhere to the required training periods, thereby maintaining the operational effectiveness of the forces.

Scope and Application

The Statutory Rules 1926 No. 67, Regulations under the Defence Act 1903-1918, amends the Financial and Allowance Regulations for the Australian Military Forces and Senior Cadets, effective immediately. The regulations apply to military personnel, including members of the Australian Military Forces and senior cadets, outlining allowances and financial provisions. These regulations also govern the management of funds within military units, including the disbursement and auditing of funds, and address specific financial responsibilities of officers such as quartermasters. The application of these regulations extends across the Commonwealth of Australia, ensuring a consistent financial framework for military personnel and units. The regulations provide specific allowances, detailing conditions under which allowances may be granted or withheld, and outline procedures for the auditing of accounts and the custody of public funds. The amendments also introduce changes to the auditing process, specifying that audits will be conducted by District Finance Officers unless otherwise arranged by the Auditor-General.

Key Provisions

The Regulations under the Defence Act 1903-1918, detailed in Statutory Rules 1926, No. 67, outline several amendments to financial and allowance regulations for the Australian Military Forces and Senior Cadets. Key amendments include changes to training allowances (Regulation 107(vi)), the removal of specific wording in Regulation 145, the replacement of Regulation 152, and the introduction of a new heading for Regulation 157 (Audit and Inspection of Unit Accounts). These amendments introduce new provisions for the audit process and the handling of disbandment of units. Regulation 157 now specifies that audits can be conducted by District Finance Officers or their representatives unless otherwise arranged by the Auditor-General. The new heading for Regulation 157 emphasizes the importance of regular audits and inspections of unit accounts. These Regulations impose specific obligations and requirements on military personnel and their commanding officers. For instance, soldiers must complete the prescribed period of continuous training to be eligible for certain allowances, as outlined in Regulation 107(vi). In the case of unit disbandment, any remaining funds, such as Petty Cash Advances, must be forwarded to the Receiver of Public Moneys for proper accounting, as stated in Regulation 152. Furthermore, the new provision in Regulation 157 mandates that audits must be conducted at the same time as cash account audits for Citizen Force Units, ensuring consistency and thoroughness in financial oversight. Failure to comply with these Regulations can lead to various consequences. While the specific offences, penalties, or civil/criminal consequences are not detailed in the provided text, it is implied that non-compliance could result in financial discrepancies, improper use of public funds, or other administrative issues. Typically, such breaches could attract penalties under the Defence Act 1903-1918 or other relevant legislation, potentially involving fines or other administrative sanctions. Given the importance of financial integrity within the military, adherence to these Regulations is crucial to maintain proper financial management and accountability within the Australian Military Forces.
