Overview
The Statutory Rules 1919 No. 221, made under the Defence Act 1903-1918, were introduced by the Governor-General, acting on the advice of the Federal Executive Council, and came into operation immediately. The purpose of these regulations was to amend the Financial and Allowance Regulations for the Australian Military Forces and Senior Cadets, effective from 1st September 1919. This change involved the substitution of certain terms to streamline the administration of financial matters within the military, specifically replacing "District Paymaster" and "District Paymaster's" with "District Finance Officer" and "District Finance Officer's", and deleting "District Pay Department" from regulation 25, replacing it with "District Accounts Office". Additionally, sub-paragraph 15 of regulation 137 was deleted. The enacting body responsible for these amendments was the Commonwealth Government, with the intent to update the nomenclature and possibly the administrative structure to better align with post-war reforms in the Defence sector.
Scope and Application
The Statutory Rules of 1919, No. 221, made under the Defence Act 1903-1918, pertain specifically to the amendment of financial and allowance regulations for the Australian Military Forces and Senior Cadets, effective from 1st September 1919. These regulations target personnel within the Australian Military Forces, including Senior Cadets, by modifying the terms used to describe certain roles and departments involved in financial and allowance processes. The changes involve the substitution of titles such as “District Paymaster” and “District Pay Department” with “District Finance Officer” and “District Accounts Office”, respectively, thereby formalising the transition of responsibilities and titles in the financial administration of the military. The regulations also include the removal of a specific sub-paragraph within regulation 137, reflecting adjustments in the administrative framework. These amendments are applicable across the Commonwealth of Australia, ensuring uniform application and interpretation of financial and allowance regulations within the military context. While the regulations themselves do not explicitly outline exclusions or thresholds, the scope of their application is implicitly limited to the financial and administrative functions of the Australian Military Forces and associated entities, reflecting the legislative intent to streamline and update the financial governance structure within the military.
Key Provisions
The main provisions of these Regulations, as set out in Section 1, pertain to the amendment of Financial and Allowance Regulations for the Australian Military Forces and Senior Cadets. Effective from 1st September 1919, the Regulations make specific changes to terminology and structure within the financial management of military forces. Firstly, the title "District Paymaster" and references to "District Paymaster’s" are replaced with "District Finance Officer" and "District Finance Officer’s" respectively (Section 1(1)). Secondly, the term "District Pay Department" in regulation 25 is replaced with "District Accounts Office" (Section 1(2)). Lastly, sub-paragraph 15 of regulation 137 is entirely removed (Section 1(3)).
These amendments impose specific obligations on the parties governed by these Regulations. Military personnel and senior cadets, along with their financial officers, must now adhere to the updated terminology and structural changes as outlined. This includes using the term "District Finance Officer" instead of "District Paymaster" and "District Accounts Office" instead of "District Pay Department". Additionally, the removal of sub-paragraph 15 of regulation 137 indicates a change in the allowances or financial provisions applicable to these individuals.
The Regulations do not explicitly detail any offences, penalties, or consequences for non-compliance. However, non-compliance with the Financial and Allowance Regulations could potentially lead to disciplinary actions under the Defence Act 1903-1918, as these Regulations are made pursuant to it. Such actions could include administrative sanctions or other forms of disciplinary measures deemed appropriate under military law. The exact nature and severity of these consequences would depend on the specific circumstances of non-compliance and would be determined in accordance with the overarching Defence Act.
