Overview
The Film and Television School Regulations, 1974, were enacted to provide further detail and administrative structure to the provisions of the Film and Television School Act 1973. This Act was introduced to address the need for a formal institution dedicated to the education and training of individuals in the film and television industry, thereby fostering talent and expertise in these creative fields. The Regulations were made under the authority of the Governor-General of Australia, in accordance with the Act, and were designed to ensure the effective governance and financial management of the Film and Television School. The policy objective, as implied by the Act and these Regulations, is to establish a robust framework that supports the operation and administration of the school, including the remuneration and allowances for its Council members, thus facilitating the delivery of quality education and training in film and television.
Scope and Application
The Film and Television School Regulations 1974, made under the Film and Television School Act 1973, govern the operational aspects of the Council responsible for the Australian Film and Television School. These regulations apply to members of the Council who are neither members of the Australian Parliament, officers of the Australian Public Service, nor state parliamentarians. The regulations set forth the financial arrangements for members attending Council meetings, including specific fees and allowances for the Chairman and other members, depending on the duration of the meeting. Additionally, the regulations address allowances for members travelling for Council duties, specifying rates for both domestic and international travel. The geographic scope of these regulations extends to the entire Commonwealth of Australia, ensuring uniform application across the nation. The regulations do not explicitly state any exclusions or exemptions, but they do provide for the financial support necessary for the effective functioning of the Council, which is essential for the oversight and governance of the Australian film and television industry.
Key Provisions
The Film and Television School Regulations, made under the Film and Television School Act 1973, outline various provisions concerning fees and allowances for members of the Film and Television School Council. For instance, section 4 specifies the fees payable to the Chairman of the Council, with $25 due for meetings shorter than three hours, and $40 for longer meetings. Similarly, section 5 details the fees for other members, who are to be paid $20 for meetings shorter than three hours and $35 for longer meetings. These sections clarify the financial obligations associated with attending council meetings.
These Regulations impose specific financial obligations on members of the Film and Television School Council. For example, members must pay fees to attend council meetings, as outlined in sections 4 and 5. Additionally, if a member is required to travel for council duties and is absent overnight from their usual residence, they are entitled to a travelling allowance at the rate applicable to officers in the Second Division of the Australian Public Service, as detailed in section 6. Furthermore, members performing duties outside Australia and its territories are entitled to allowances similar to those of Second Division officers, as per section 7. These provisions ensure that council members are adequately compensated for their time and travel expenses related to council duties.
The Regulations do not explicitly mention offences, penalties, or consequences for non-compliance with the specified fees and allowances. However, any breach of the Film and Television School Act 1973, under which these Regulations are made, could lead to legal repercussions. The Act itself may outline penalties for non-compliance, but the Regulations focus primarily on clarifying financial obligations rather than prescribing penalties. Therefore, while the Regulations do not directly address penalties, adherence to the Act's provisions is crucial to avoid potential legal consequences.
