FENCING REGULATIONS 1985

I, Peter Michael Ilyk, Deputy Administrator of Norfolk Island, acting in accordance with the advice of the Executive Council of Norfolk Island, hereby make the following Regulations under the Fencing Act 1913.

Short title
1. These Regulations may be cited as the Fencing Regulations 1985.
Interpretation
2. (1) In these Regulations “the Act” means the Fencing Act 1913.
(2) For the purposes of these Regulations, unless the contrary intention appears, words, expressions and provisions have the same interpretation, application and effect as they have under the Act.
Minimum standards of artificial structures
3. For the purposes of registration under the Act the minimum standards of artificial structures forming a fence or part of a fence are as specified in the Schedule.
Hedges
4. A fence or part of a fence that is composed of a hedge shall be supported by an artificial structure that complies with the minimum standards specified in the Schedule.
SCHEDULE
Regulation 3
MINIMUM STANDARDS OF ARTIFICIAL STRUCTURES
1. FENCES AND GATES
(a) Openings
Openings shall not exceed 20 centimetres high and 91 centimetres broad, such breadth to be parallel to the ground or any other part of the fence that is parallel to the ground.
(b) Height
The top level of the fence shall be not less than 1.5 metres from the ground.
(c) Posts
Posts shall be securely fixed not more than 3.66 metres apart.
(d) Droppers
Droppers in a —
(i) barbed wire fence - shall be not more than 91 centimetres apart; or
(ii) plain wire or mixed plain and barbed wire fence - shall be not more than 61 centimetres apart.
(e) Gate latches
Gate latches shall be sound and secure and not capable of being opened by animals.
2. CATTLE GRIDS
(a) A cattle grid shall, between the outside border at the fence line and its parallel inside border, be not less than 1.83 metres.
(b) the parallel bars comprising the grid —
(i) if not round, shall not exceed 5 centimetres across the top; and
(ii) shall be not less than 12 centimetres apart.
(c) The borders of the grid to which the parallel bars are fixed shall not exceed 15 centimetres in width.
(d) the depth of the well beneath a cattle grid shall be not less than 60 centimetres.
