IN pursuance of sub-section 40 (3) of the Family
Law Act 1975, I, SIR JOHN ROBERT KERR, the
Governor-General of the Commonwealth of Australia,
acting with the advice of the Federal Executive
Council, hereby–
(a) fix 1 June 1976 as the date on and after
which proceedings of the classes to which this
Proclamation applies may not be instituted in
or transferred to the Supreme Courts of the
States of New South Wales, Victoria, Queens-
land, South Australia and Tasmania and of
the Australian Capital Territory and Norfolk
Island; and
(b) declare that this Proclamation applies only to
proceedings of the classes specified in the
Schedule.

SCHEDULE
Classes of Proceedings to which Proclamation applies
Proceedings of a kind referred to in paragraph (a)
of the definition of ‘matrimonial cause’ in sub-section
4 (1) of that Act other than cross-proceedings in the
course of proceedings of such a kind where those
last-mentioned proceedings were pending in the
Supreme Court of the State or Territory concerned
immediately before 1 June 1976.
Proceedings of a kind referred to in paragraph (b)
of that definition.
Proceedings of a kind referred to in paragraph
(c), (d), (e) or (f) of that definition other than –
(a) proceedings that relate to proceedings for
principal relief pending in the Supreme Court
of the State or Territory concerned immediately
before 1 June 1976; or
(b) proceedings between parties between whom
proceedings of a kind referred to in paragraph
(c), (d), (e) or (f) of that definition were so
pending immediately before that date.
